<r,InRe:PennsylvaniaPowerLightC.andAlleghanyElectricCooperative,IQ.SusquehannaSteamElectricStation,.Units1and2.UCLEARREGULATORYCOMMISSIONDOCKETNOS.50-387and50-388SUPPLEMENTTOPETITIONFORLEAVETOINTERVENEOFCOLLEENMARSHETAL,,OUTLINGANDLISTINGCONTENTIONSNOWcomeColleenMarshandElevenOthers,Petitionersherein,andSupple-menttheirPetitionForLeaveToIntervenetoincludethefollowingcontentions:1.TheproposedprojectcreatesanunreasonableriskofharmtothehealthandsafetyofPetitionersandothermembersofthepublicduetothefollowingspecificreasonsorbases:A.ApplicantsdesignfailstoresolvetheproblemofpumpflywheelmissilesgeneratedbycoolantpumpoverspeedintheboilingwaterreactorswhichposesanunreasonableriskofharmtothehealthandsafetyofPetitionersandothers.TheelectricalbrakingproposedbyApplicantisnotsufficienttopreventthisproblem.B.Applicantfailstoprovideadequateon-sitestoragefacilitiesinitsdesigntosafelystorebothhighandlowlevelradioactivematerials.Thedisigncontemplatestempoxarystorageon-siteoflowlevelmaterials,yetsincenoavenuesremainopenforapplicanttodisposeofal1,radioactivewaste,spentfuelandmaterialselsewhere,theApplicantmayhavetostorethespentmaterialslonger,upto10to15years,,thanitispreparedsafelytocontainandmonitorforsuchaperiodoftimeon-site.C.Applicanthasfailedtoprovide,ordemonstrateinitsapplication,adequateplansforthesafetransportationinconnectionwiththeradioactivematerialsproducedinconnectionwiththeoperationofSusquehannaSteamElectricStation.D.Applicant'sdesignfailstosolvetheproblemofflow-inducedvibrationinthecore,therebycreatingin-vesselspargerfailure.2.Applicantsproposedfacilitiescreat+anunreasonableriskofharmtotheprivatepropertyofPetitionersandothermembersofthepubliclocatedwithin50milesoffacilitiesforallthereasonssetforinParagraphOne,A-DofthisSupplementtoPetition.3.petitionersandthePublicareexposedtounreasonableriskofharmtopersonalsafetyandpropertyduetotheprotectionofthePowerCompanyundertheFederalPrice-AndersonActwhichlimitsitsliability.4.DuetothefactsandcircumstancessetforthinParagraph'-One,A-D,ApplicantsproposedfacilitiesviolatethisCommission'sStandardsforprotectionagainstradiationsetdownin10CFR20.1etseq.and10CFR20.105(a)whichpro-videsforpermissiblelevelsinunrestrictedareasandtheenvironmentaroundtheFacilities.

0page25.ApplicantsproposedFacilitiesareunreasonablycostlyanduneconomicalbothtoPetitionersandthepublicduetothefollowingreasonsandbases:A.Theoutputofelectricitytobeproducedbytheproposedfacilities,inre-lationtocost,willbelowerthanelectricitygeneratedbyexistingformsofenergyandthereforemoreexpensivetoPetitionersandothers.B.TheprojectedcostoffacilitiesofApplicantfailstoaccountfor,orin-clude,theexpectedcostofdecommissioningthefacilitiesafteritsestimatedusefullifeof30years.Suchcostisatleastequaltothecostofconstructionandwillbebornebyfutureconsumersandtaxpayers.C.ThefacilitiesareunnecessaryandwastefulastheelectriccapacityofPP&Lin1977was40%greaterthancustomerneedsanddemandsfromexistingfacilities.Latestprojections'fenergyuseandrequirementsduringthenext30yearsforthePP8r.Lservicearea,theperiodequaltotheprojectedplants"usefullife",showthatPPRLcanmeettheneedsofitscustomersthroughexistingfacili-tiesandsourceswithoutinvestinginacostlyandunreasonablydangerousnuclearfacility.D.PennsylvaniaUtilityCommissionregulationswouldpermitApplicanttobaseitsrates,inpart,accordingtocapital.investmentinfacilities,andtherebydoubleutilityratesforPPRLasitstotalinvestmentforallfacilitieswillbedoubledaftercompletionoftheprojectedfacilities.ThiscostwillbebornebylocalPPRLcustomers,yettheunneededelectricitywillbesoldoutsideofthePPRLservicearea.6.TheApplicantsfailtoadequately.provideplansforinformingthepublicastoevacuationproceduresincludingdrillsandwarningsintheeventofradiationleakage.
