Plant Status and Inspector Insights D. Simpkins provided a briefing on current plant activities.

Discuss Inspection Plans Geoff Wright presented the inspection plan for the Phase 3 Management and Human Performance inspection. The Panel approved the plan with minor comments to include the addition of the RAM items that would be addressed by the inspection. Final plan approval is required by J. Dyer to authorize IP40001.

On a separate point, there was considerable discussion of the process to ensure receipt of the draft report and final reports from S. Haber, the licensees consultant.

The panel discussed the scope and breadth of the ongoing RP 95002 supplemental and restart readiness effort, and the level of depth needed to close 95003 items. Per John House, the team did not plan to review every RAM item assigned, and failed to see the value of reviewing program areas not know or suspected to be deficient. The panel felt that we needed to articulate how each requirement was addressed, and concurred that if the team had sufficient basis to conclude that an area was not deficient, such documentation would be adequate to close the 95003 item.

Discuss Chilling Effect Letter Status and Allegation RIII-2003-A-005 The Panel discussed the need for a chilling effect letter, given that the licensee had already provided its corrective actions on the docket to address deficiencies with the sites Safety Culture, of which a safety conscious work environment was a subset. In addition, the licensee had met with the NRC to discuss its corrective actions. The panel felt that this decision should include input from the Agency Allegation Advisor, and requested that she be contacted to see if she agreed with the approach. Assuming her agreement, the panel felt a chilling effect letter to the licensee was not necessary.

NEW ACTION ITEM - M. Phillips took action to provide an e-mail to the AAA describing why the panel felt a chilling effect letter was not needed and request her concurrence in that decision.

The panel discussed the approach that should be taken to address the chilling effect concern in allegation RIII-2003-A-005, and directed that this activity was more appropriate as a DRP function rather than a panel function.

Discuss Action Items The Panel discussed the list of open action items. The Panel directed that Action items 151 and 158 be closed due the actions being accomplished.

Item 151 - "Develop a plan to assess the safety culture at the plant to close Restart Checklist Item 4.b, effectiveness of corrective actions.

Item 158 - "In Programs inspection plan add Restart Checklist Item 3.1, completeness and accuracy of information, and delete 3.h, radiation protection program."

Discuss New Possible Action Item or AITS The panel verified that Roland was preparing a memorandum from Dyer to Travers briefly documenting the results of the Governor Taft briefing.

Discuss Restart Action Matrix (RAM)

The panel agreed that they needed to be involved in the closure of items that were based on not applicable. The discussion of the RAM was tabled to be added to the agenda of the next panel meeting, with the latest version of the RAM attached to the Agenda.

Discuss New Inspection Procedure IP71007, Reactor Vessel Head Replacement Inspection The panel was informed that all actions required by the module had been addressed by the inspections performed to date with two exceptions. The VT2 test and control rod drive testing. The panel determined that the VT2 test was covered by the NOP test, and requested the RAM be updated to include the control rod drive test.

NEW ACTION ITEM - M. Phillips took action to add a new concern to the RAM to address control rod drive test.

Discuss Items for Licensee Weekly Calls The Panel discussed discussion topics for the next weekly call with the licensee and agreed that there was a need to continue to press them for LERs and LERs under review. Also, the licensee needs to provide a status on its electrical design calculations and when will corrective actions to address calculation results be identified.

Discussion of Licensing Issues and Actions J. Hopkins and A. Mendiola discussed the status of licensing issues and actions. No new items were identified. There was some discussion on what documentation should be provided to close the Restart Checklist items 6.a, 6.e, and 6.f. The decision was to

utilize a feeder to the resident inspection report, with the feeder going through the normal NRR process.

Discuss/Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments. The June Public Meeting date was confirmed (June 3rd), and the public RP95002 exit was added for the morning of April 15th.
