SUBJECT:

ACKNOWLEDGMENT LETTER OF LICENSEE RESPONSE TO NOTICE OF VIOLATION [NRC OFFICE OF INVESTIGATIONS REPORT NO. 3-2002-031]

Dear Mr. Anderson:

This will acknowledge receipt of a letter from the FirstEnergy Nuclear Operating Company (FENOC), dated April 30, 2004, in response to our letter dated April 1, 2004, transmitting a Severity Level III Notice of Violation. The findings involved the failure to follow Technical Specification 5.2.2.e overtime guidelines in that individuals worked in excess of 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> in a 7-day period and the immediate supervisors failed to request deviations from the overtime guidelines in advance from the Plant Manager or authorized designee. We have reviewed your corrective actions and have no further questions at this time.
