ACKNOWLEDGEMENT OF WITHDRAWAL (TAC NO. L24484)
Dear Mr. Freeman:
By letter dated October 29, 2010 (ML103090264), NextEra Energy Seabrook, LLC (NextEra) submitted a request for a partial exemption from search requirements contained in 10 CFR 72.212(b)(5)(iii) and 10 CFR 73.55(h)(3)(i) for dry fuel storage at the Seabrook Station Independent Spent Fuel Storage Installation (ISFSI), pursuant to 10 CFR 72.7 and 10 CFR 73.5. On February 16, 2011, the Nuclear Regulatory Commission (NRC) revised its regulations renumbering 72.212(b)(5) as 72.212(b)(9)(iii). The requirements of 10 CFR 72.212(b)(9)(iii) allow pat-down searches of individuals in lieu of searches by detection equipment prior to entering protected areas as required by 10 CFR 73.55(h)(3)(i).
By letter dated August 22, 2011, NextEra requested to withdraw the application from NRC review. The NRC acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Technical Assignment Control number has been closed. If you have any questions, please contact me at (301) 492-3148.
