Dear Hr. Fitzpatrick:
We have received the enclosed Federal Emergency Management Agency (FEMA) correspondence dated June 5,
1995 transmitting two Deficiencies to the State of Michigan regarding the Hay 9, 1995 Emergency Preparedness Exercise at the D.
C.
Cook plant.
We fully recognize that any corrective actions to be implemented may involve parties and political institutions which are not under your direct control.
Nonetheless, we expect that assistance, if appropriate, will be extended.
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed FEHA correspondence will be placed in the NRC Public Document Room.

, Management Agency' (FEMA) identification of two Deficiencies which 'occurred during the D.C.
Cook Radiological Emergency Prepax'edness (REP) exercise conducted on May 9, 1995.
These issues were discussed during the post-exercise participants'riefing on May 12, 1995.
A remedial.corrective action ie required within 120 days of the exercise, but no later than September 7,
1995.
The two Deficiencies were assessed against Berrien County.
First,; Objective 10, Alert and Notification, Berrien County failed to activate sirens and broadcast an emergency message within 15 minutes of the initial Protective Action Order (PAO) from t'e State.
- Second, Objective 11, Public Instructions and Emergency Information, the County informed the public to evacuate
.instead of to shelter-in-place.
Third, the County broadcast an incomplete and erroneous message following the third PAO.
In accordance with 44 CFR 350.9(d) and FEMA-REP-14, we have thoroughly reviewed and discussed these'ssues with FEMA, Headquarters and the U.S. Nuclear Regulatory Commission.

page C.16-1, defines a Deficiency as "...an observed or identXfied inadequacy of organizational perfoxmance in an exercise that could cause a finding that offsite emergency prepaxedness is not adequate to pxovide reasonable assurance that appropriate pxotective measures can be taken in the event oC a radio];ogical emergency to prot'ect the health and safety of =he publia living in the vicinity of a nuclear power plant.<<
Because of the potential impact of a Deficiency on the publ'c health and safety, it should be corrected within 120 days after the exercise through appropriate remedial actions, including remedial exercises, drills, or other actions, including plan revisions.
