NOTICE OF VIOLATION Northern States Power Company Docket Nos. 50-282, 50-306 Prairie Island Units 1 and 2 License Nos. DPR-42, DPR-60 During an NRC inspection conducted on March 30 through May 31, 1993, two violations of NRC requirements were identified.

In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violations are listed below:

A.

Technical Specifications 2.3. A.2.d (Overtemperature 4T) and 2.3. A.2.e (Overpower 4T) require that for each percent that the magnitude of q, - q, exceeds +9 percent (where q, and q, are the percent power in the l

top and bottom halves of the core, respectively) the Overtemperature 4T and Overpower 4T reactor trip set points shall be automatically reduced by an equivalent of 2.5 percent of rated thermal power.

Contrary to the above, from January 22 through February 4, 1993, the licensee operated Unit 1 in a condition where the Overtemperature 4T and Overpower 4T reactor trip setpoints would not have been automatically reduced when q, - q, exceeded +9 percent.

This is a Severity Level IV Violation (Supplement I).

B.

Technical Specification 3.6.C.3 states that with one or more valve (s) listed in Technical Specification Table TS 4.4-1 inoperable, within four i

hours:

(a) restore the inoperable valve (s) to operable status or, (b) 4 deactivate the operable valve in the closed position or, (c) lock closed at least one valve in each penetration having one inoperable valve.

Table TS 4.4-1 lists containment penetration No. 45 (Reactor Makeup to PRT) which includes air-operated isolation valve CV-31342 and check i

valve 2RC-3-1, 2RM-8-4 is the upstream manual isolation valve for CV-31342.

Contrary to the above, on April 13,1993, CV-31342 was inoperable for greater than four hours, but was not deactivated in the closed position by isolating its air supply, or in lieu of that, 2RM-8-4 was not locked closed since check valve 2RC-3-1 could not be deactivated in the closed position.

This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Northern States Power Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington. D.C.

20555 with a copy to the Regional Administrator, Region III, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the i
