SUMMARY

OF MARCH 20, 2020, PUBLIC MEETING WITH NUCLEAR INDUSTRY TO DISCUSS COVID-19 REGULATORY IMPACTS On March 20, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a public teleconference with representatives from the nuclear industry, including the Nuclear Energy Institute (NEI), NextEra, and Entergy. The purpose of the meeting was to discuss regulatory impacts resultant from the COVID-19 pandemic. The meeting notice can be found in Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20079D897 and additional information related to the meeting can be found in ADAMS at Accession No. ML20079L589.

At the start of the meeting it was reinforced the meeting was an information gathering dialogue only and as always for NRC public meetings, no regulatory decisions will be made. Additionally, it was reinforced that none of the information provided in the meeting was to be taken to be a request by any licensee or a decision by the NRC. It was stated that actual licensing requests should still be submitted in the normal fashion and coordinated with the assigned Project Manager.

After Ho Nieh, Director of the Office of Nuclear Reactor Regulation made opening remarks it was turned over to Jennifer Uhle of NEI, Ron Gaston of Entergy, and Bill Parks of NextEra to make opening remarks.

Mr. Thomas Basso of NEI led a discussion with the NRC staff regarding identification of regulatory issues related to the COVID-19 pandemic. Items for discussion were the following (these questions can also be found in the additional meeting information at ADAMS Accession No. ML20079L589):

How will the NRC handle NOEDs [Notice of Enforcement Discretion]?

In 2007, NEI requested the staff to consider issuing an EGM [Enforcement Guidance Memorandum] to cover pandemic situations and asked if the NRC plans to use this approach, what would be the timeline for issuance?

What areas is the NRC considering for application by an EGM? What about administrative reports? What about medical physicals?

How does the NRC see the EGM being applied? Entry and exit criteria?

As stations continue to maintain qualified personnel, what alternatives and options are being considered by the NRC to support maintaining those qualifications?

What are NRCs thoughts on most expedient approach to manage Title 10 of the Code of Federal Regulations (CFR) 50.55a related issues?

No regulatory decisions were made in the meeting.

During the public question and answer session of the meeting, NRC staff addressed questions on the following topics:

Limiting fuel movements for operating and decommissioning plants.

Testing of employees of COVID-19 at the nuclear power plants.

Regulations for minimum staffing requirements.

Status of the EGM and if would be made publicly available.

NRCs jurisdiction and Federal authority if a plant has staffing issues.

10 CFR Part 72 Independent Spent Fuel Storage Installations (ISFSI) facilities share resources with 10 CFR Part 50 nuclear power plant personnel due to common programs and what considerations are being made in this regard, limiting fuel movements, etc.

NRC regulatory authority related to personnel protection equipment.

Where members of the public can find NRC approvals of longer work hours (e.g.,

website)

What NRC will do to monitor fatigue for longer work hours and possible impacts on fuel transfer to dry casks and security attentiveness.
