Dear Administrative Judges:

I am writing to notify the Board of a potential scheduling conflict with regard to upcoming hearings on offsite emergency planning matters.

This letter also encloses a Notice of Withdrawal of Commonwealth Offsite EAargency Planning Issue-l.

The undersigned counsel for the Commonwealth is legal counsel to the Pennsylvania Governor's Energy Council.

The Energy Council staff is an active party to the recently-instituted Pennsylvania Public Utility Commission investigation of whether completion of Limerick Unit II is in the public interest.

The Administrative Law Judge in that proceeding has scheduled a conference among all

' parties for December 12, 1984.

The conference will involve discussion of the critical issues in the proceeding and it is intended that the parties utilize the conference to settle and/or stipulate as to particular matters where possible.

Evidentiary hearings in this proceeding have already been scheduled for January 2-16, February 18-27 and March 18-22, 1985.

The December 12 conference is thus vital to the future course of the PUC proceeding.

So that I may represent the GEC staf f at the December 12 conference, I request that this Board leave open December 11 and 12 in its schedule for offsite emergency planning evidentiary hearings and limited appearance sessions.

Counsel for the City of Philadelphia, Martha Bush, is in the same position with regard to the PUC investigation and joins in this request.

Both Ms.

Bush and I understand that potential schedule conflicts among multiple proceedings are an expected fact of life in administrative practice.

We have therefore filed this request with the Board at an early juncture so that the Board could fairly consider our concerns.
