W 20 W Docket No:

50-57 State University of New York at Buffalo ATTN:

Dr. D. W. Rennie Vice-President for Research and Graduate Studies 521 Capen Hall Amherst, New York 14260 Gentlemen:

Subject:

Timely Renewal of NRC Approved Programs This distributes information about a recent event at a research reactor in NRC Region I.

The licensee's NRC approved Quality Assurance Program for Radiation Material Pack-ages expired on December 31, 1985.

No renewal request was submitted before license expiration, as provided in 10 CFR 2.106.

Therefore, the licensee was not author-ized to transport licensed materials subsequent to December 31, 1985.

However, a shipment of spent fuel was made on January 27, 1986.

There were no radiation control inadequacies with that shipment, but it was made without a proper license.

It is each licensee's responsibility to assure that activities are conducted in accordance with requirements, including the Code of Federal Regulations and a valid license.

Each licensee must request needed license renewals prior to their ex-piration.

All research and test reactor licensees should be aware of expiration dates for various programs at their facilities and take required actions accordingly.

Sincerely, 9risinal signed MS Edward C. Wenzinger, Chief Projects. Branch No. 3 Division of Reactor Projects cc:
