SUMMARY
OF MARCH 17, 2022, PUBLIC MEETING WITH ENERGY HARBOR NUCLEAR CORP REGARDING PLANNED LICENSE AMENDMENT REQUEST TO CONSOLIDATE FUEL DECAY TIME REQUIREMENTS IN A NEW LIMITING CONDITION FOR OPERATION FOR BEAVER VALLEY POWER STATION, UNITS 1 AND 2 (EPID L-2022-LRM-0020)
On March 17, 2022, a public meeting via webinar was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Energy Harbor Nuclear Corp. (the licensee). The purpose of the meeting was to discuss technical specification (TS) changes that the licensee plans to submit as part of a planned license amendment request (LAR) to consolidate TS irradiated fuel decay time requirements into a new decay time limiting condition for operation (LCO) TS Subsection at Beaver Valley Power Station (Beaver Valley),
Units 1 and 2. The meeting notice and agenda, dated March 4, 2022, are available in the Agencywide Documents Access and Management System (ADAMS) Accession No. ML22063A469. The presentation material used by the licensee during the meeting is available in ADAMS Accession No. ML22061A139. A list of attendees is enclosed.
During the meeting, the licensee presented information regarding a planned license amendment request to consolidate TS irradiated fuel decay time requirements into a new decay time LCO TS Subsection. The licensee discussed the following topics as part of its presentation:
Regulatory history of decay time requirements The licensee discussed the Beaver Valley fuel handling accident (FHA) analysis assumptions and history of decay time requirements in the Beaver Valley Units 1 and 2 TS and Licensing Requirements Manual (LRM).
The current decay time requirements in TS for Beaver Valley Units 1 and 2.
The licensee discussed current LCOs that have applicability statements referencing movement of recently irradiated fuel assemblies and movement of fuel assemblies over recently irradiated fuel.
The proposed changes to the current decay time requirements in TS for Beaver Valley Units 1 and 2.
The licensee proposed new TS LCO Subsection 3.9.7, Decay Time, and discussed its proposed decay time limit, and associated applicability, action, and surveillance requirements. The licensee proposed deleting four TS LCO Subsections and removing reference to recently irradiated fuel from seven other TS LCO Subsections in conjunction with the creation of proposed TS LCO Subsection 3.9.7.
Submittal schedule The licensee discussed its planned submittal schedule, requested approval date, and revised TS implementation period.
The NRC staff provided feedback on the planned submittal and asked questions throughout the presentation. The NRC staff asked the licensee to discuss the following items in more detail during the meeting and also to describe them in more detail in the planned LAR:
Provide the rationale for removing the previous plant-specific TS LCO Subsection for decay time upon adopting the improved TS for Beaver Valley Units 1 and 2, which were based on NUREG-1431, Standard Technical Specifications Westinghouse Plants.
Explain how proposed new TS LCO Subsection 3.9.7 justifies the proposed deletion of four TS LCO Subsections and proposed removal of references to recently irradiated fuel in seven other TS LCO Subsections. Explain how the availability and operation of systems associated with the four LCOs proposed for deletion will be controlled.
In lieu of deletion, explain why the four LCOs proposed for deletion are not proposed for relocation to a licensee controlled document, which is consistent with the Commission final policy statement on TS improvements; and if they were relocated, explain how changes to the associated relocated LCOs will be controlled. Specifically, TS 3.3.6 for Unit 2, TS 3.7.12, TS 3.9.3, and TS 5.5.7.
Provide justification to show the current assumptions in the FHA analysis are adequately assured without meeting the TS LCOs proposed for deletion.
No regulatory decisions were made during the meeting. Members of the public were in attendance. No comments or questions from the public were received during the meeting.
