- understand now that you indicated your willingness to provide us with your view on the issues of " deliberateness, willfulness and/or intent." Depending
- on how you come out on this issue, we would then be in a position to revise ,
i any applicable staff positions or enforcement actions. When you provide us with your views on this subject, please include references to those sections
, in the investigation reports we received or any other material that would i I
apply. We must have these references to support any revisions in staff positions. As you know, we have questions from Chairman Udall awaiting answers on this matter. I do not think we should delay answering these questions much longer. Could you get us a reply by next week so that we can !
take whatever actions needed and get a prompt reply back to the Congress. j
. I would also like to emphasize the points made in my September 21 memorandum to you on the need for 0! conclusions on a generic basis. We would save a good deal of misunderstanding if we could have the expert views of OI on these very difficult issues of wrong-doing, wi11 fulness, etc.
