SUBJECT: VOGTLE ELECTRIC GENERATING PLANT - NRC TEMPORARY INSTRUCTION 2515/186 INSPECTION REPORT 0500424/2013405, 05000425/2013405

Dear Mr. Tynan:

On May 31, 2013, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at your Vogtle Electric Generating Plants, using Temporary Instruction 2515/186, "Inspection of Procedures and Processes for Responding to Potential Aircraft Threats." The enclosed inspection report documents the inspection results which were discussed on May 31, 2013, with Mr. Jesse Thomas and other members of your staff.

The objective of this inspection was to assess the implementation procedures and processes of the Vogtle Electric Generating Plants that are required by Title 10 of the Code of Federal Regulations (CFR), Part 50.54(hh)(1), which provides the requirements for responding to a potential aircraft threat. The results from this inspection, along with the results from other operating commercial nuclear plants in the United States, will be used to evaluate the U.S.

nuclear industry's readiness to safely respond to similar events. These results will also help the NRC to determine if additional regulatory actions are warranted.

No findings were identified during this inspection. One licensee-identified violation is listed in Section 4OA7 of the report. The NRC is treating the violation as a non-cited violation (NCV) consistent with Section 2.3.2 of the Enforcement Policy.

If you contest the violation or significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region II; the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Resident Inspector at the Vogtle Electric Generating Plant. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system, ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the PARS component of NRC's ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response "Security-Related Information - Withhold from public disclosure under 10 CFR 2.390" in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390 (b)(1).

In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response contained in the enclosure, and in accordance with 10 CFR 2.390, a copy of this letter's enclosure will not be available for public inspection.
