Dear Ms. Bladey:

The Commonwealth of Pennsylvania, Department of Environmental Protection ("PADEP")

submits the following comment on the Peach Bottom Atomic Power Station Units 2 and 3:

Proposed License Amendment to Increase the Maximum Reactor Power Level. PADEP is the certifying agency underSecticy 401 of the Federal Water Pollution Control Act, 33 U.S.C.

Section 1341 ("Clean Water Act").

PADEP does not have specific detailed comments at this time because Exelon just recently submitted a water quality.certification request for this project. Under the Clean Water Act; water quality certification is required prior to the issuance of the license amendment. Pennsylvania has detailed regulations concerning water quality certification and it would be premature to comment on this project prior to having an opportunity to review the environmental assessment required by those regulations. See 25 Pa. Code Section 105.15(b).

PADEP has also had extensive discussions about the NPDES Permit required for this project with Exelon. Exelon has just concluded the field work for a four-year study to determine the thermal impact of the proposed extended power uprate, and is preparing a final report for PA DEP as part of the NPDES permit. Exelon has indicated that the application for the NPDES permit will be submitted in the next several months.
