(RCCA), Public Health and Sustainable Energy (PHASE), Sierra Club -Atlantic Chapter (Sierra Club), and New York State Assemblyman Richard L. Brodsky (hereinafter "Petitioners")

submit this letter in further support of their contention 15.!kT ~S~/( ) ýcýý As submitted by WestCan on December 10, 2007. Contention 15 asserts that Entergy's LRA fails to satisfy 10 C.F.R. § 54. 31. Contention 15 asserts that the NRC regulations provides that in the event the NRC approves the LRA, then the old license is retired, and a new superseding license will be issued, as a matter of law § 54.31. Therefore all citing criteria for a new license must be fully considered including population density, emergency plans and seismology.

At the Nuclear Regulatory Commission's public meeting in Cortland Manor on June 18, 2008 five NRC senior officials discussed progress of the Indian Point LRA and the current status of Indian Point owner's request for 20 additional years of operation.

Present were Sam Collins, D. Roberts, R Conte, Rani Franovich, Chief License Renewal Branch, NRR, Dr. Bo Pham and others. Twice Ms. Rani Franovich made the statement that the license extension as a "new license" for the facility.The statement by Ms. Rani Franovich, Chief License Renewal Branch is in direct contradiction to the Staff Response to Contention 15, and as such clearly indicates that this is an substantial issue of law and fact that is in dispute that must to be heard by the ASLB.

Accordingly, Petitioners respectfully request that Rani Franovich's statement be considered by the Atomic Safety Licensing Board and participants in the Indian Point license renewal proceeding.
