SONGS NUCLEAR SAFETY CONCERNS, LETTER TO THE U.S. NUCLEAR REGULATORY COMMISSION'S OFFICE OF THE INSPECTOR GENERAL, DATED AUGUST 24, 2009
Dear Mr. Mills:
The NRC staff is in receipt of your enclosed August 24, 2009, letter to the U.S. Nuclear Regulatory Commission's (NRC) Office of Inspector General regarding whether an individual who pled guilty to a marijuana possession charge could be hired by the San Onofre Nuclear Generating Station (SONGS).
The staff has reviewed your question and notes that in order for licensees to hire an individual who has pled guilty for possession of marijuana, they must follow the provisions of Title 10 of the Code of Federal Regulations, Part 26, Subpart C, "Granting and Maintaining Authorization." In particular, sections 26.55, 26.61, 26.63 and 26.69 provide the specific requirements that licensees must follow to grant a person with a previous drug offense unescorted access to the site's protected area. Furthermore, the staff has determined that your particular question does not constitute an allegation when evaluated by the criteria defined by the NRC's allegation program.
