The purpose of this letter i s to inform you of our assessment of y our safet y perfo rmanc e during this peri od and our plans fo r fut ure inspe ctions a t your f acility.This performance rev iew and enclosed i nspection pl an do not i nclude phy sical protec tion information. A se parate letter de signated and marked as "Official Use Onl y - Securi ty-Related Information" wil l includ e the phys ical protecti on review and resultan t inspection plan.Overall, Oyster Creek operat ed in a manner that preserved public health and safet y and fully met all corne rstone objectiv es. Plant p erformance for the most recent quarter was w ithin the Regulatory R esponse col umn of the NRC' s Action M atrix, based on one in spection findi ng being classi fied as havi ng low to mo derate safety si gnificance (White) in the Emergency Planning (EP) Cornerstone an d all PIs indicating p erformance at a lev el requiring no additiona l NRC o versi ght (Gree n). The White findi ng, docu mented in a l etter d ated J anuary 9, 200 6, involv ed Oyster Cree k staff not recognizing that plant parameters met emergency acti on level (EAL) thresh olds durin g an ev ent in August 2005. Lookin g back, s afety p erformanc e for Oy ster Cr eek wa s in t he Degr aded C orners tone C olumn of NRC's Acti on M atrix in th e thir d quarte r 2005 , base d on a prev iousl y id entifi ed White inspection finding in the EP Cornerstone "overlapp ing" the current White finding. This previous finding invo lved an inadequate EP event cl assification p rocedure, wh ich was closed in an inspection report issued July 15, 2005. In M ay 2006, th e NRC pla ns to conduct a 95002 supplemental inspection to evalua te the effectiveness of your correcti ve action s to address performance in the EP Cornerstone
.In our mid-cy cle assessment letter, dated A ugust 30, 2005, w e advise d you of the c ontinuation of a sub stanti ve cr oss-cu tting i ssue i n the a rea of p roble m iden tificat ion a nd res oluti on (PI&R). During this as sessment period , there were six ins pection findi ngs that were attributable, a t least in part, to w eaknesses in P I&R. Based on the findings n ot sharing a common performance theme, and that i n general, yo u have de monstrated timely and effective co rrective acti ons following i mplementation o f program improvements i n June 2005, we hav e concluded that the C. Crane 2 cross-cutting issu e is close d.In summary, Oyste r Creek was o perated safely and is curre ntly in the Regulatory Response column of the NR C's Action Matrix. The NRC cl osed the PI&R substantiv e cross-cutting i ssue, which h ad been ope n for calendar y ear 2005.The enclosed inspection plan detai ls the insp ections, les s those relate d to physi cal protectio n, scheduled th rough September 30, 2007. The ins pection pla n is prov ided to al low for the resolution o f any schedul ing conflicts an d personnel availab ility i ssues wel l in adv ance of inspector arri val onsi te. Routine resident ins pections are not listed d ue to their o ngoing and continu ous natu re.
