On August 8, 2006, the NRC staff complete d its safety p erformance review of the Salem Nuclear Genera ting Station for the first half of the calen dar year 20 06 assessment cy cle. Our technical s taff reviewed p erformance indicato rs (PIs) for the most rece nt quarter and in spection results ove r the previ ous twelv e months. The purp ose of this le tter is to inform y ou of our assessment of you r safety performance du ring this peri od and our p lans for future insp ections at your f acility.This safety performance review and enclo sed inspecti on plan do not inclu de physi cal protectio n information. A separat e letter designated and mar ked as "Exempt from Public Disclosure in accordance w ith 10 CFR 2.390" wi ll incl ude the resul ts of our physi cal protectio n review and resultant ins pection pla n.Plant performance for the most recent quarter at Salem Units 1 and 2 w as withi n the Licens ee Response Co lumn of the NRC
's Action Matrix, based on al l inspecti on findings bei ng classified as havin g very lo w safety si gnificance (Green) an d all PIs indicating p erformance at a lev el requiri ng no a dditi onal NRC o versi ght (Gree n).In our an nual asse ssment letter d ated Marc h 2, 2006, we advised you th at a subs tantive cross-cutting issue in the area of safety conscious work environm ent (SCW E) continued. This was based on the resul ts of our team insp ection of SCWE completed in September 2005 , which determined that while progress had been made, there remai ned some issu es that required addition al action. Our let ter also stated that th e NRC would evalua te the SCW E substa ntive cross-cutting issu e for closure after y ou provid ed the results of an assessment th at concluded that substantial, sustainable pro gress had been made in the work environment , and the NRC had c ompl eted a revie w which c onf irme d tho se re sult s. Dur ing t he f irst six mo nths of 20 06, we noted that you conducted a safet y culture survey which indicated improvement in nearly all cultural metric s when co mpared to the resu lts of a previ ous survey in 2005.
Additional ly, you comple ted a p eer as sessme nt of y our w ork env ironme nt wh ich co nclud ed tha t subst antia l, sustainable progress had bee n made. The resul ts of this assessmen t were prov ided to the NRC in a letter dated May 4, 2006. The NRC reviewed the assessment report, and in June 2006, co mpleted a team i nspection of SC WE. Our inspection report, da ted July 31, 2006, documents our conclusion that you have made substan tial progress in improving the SCW E, and that programs are in place to sustain th is progress.

Levis 2 As part of our mid-year assess ment, we reviewed the results of team inspections, the trend in quarterly SCWE metrics submitte d to the NRC , the number and nature of alle gations receiv ed durin g the as sessme nt peri od, an d the s ignific ance a nd cha racteri stics of insp ectio n findi ngs to dete rmin e whet her t his in for mat ion in dica ted im prove ment in the SCW E. Ou r revi ews confirmed that there h as been subs tantial and sustained p rogress in improv ing the SCWE at the Salem station. Based on t hese res ults, an d your ong oing imp rovemen t action s, we have concluded that the substantive cross-cutting issue in the SCW E area is closed. W e will continue to mon itor your p erformance in this area during NR C baselin e inspectio ns. For example, the NRC plan s to revie w recommendati ons from the indep endent peer as sessment of the SCWE, which are tra cked in you r corrective action program, through a baselin e problem ident ificati on and resol ution insp ectio n sampl e. Additional ly, we have dete rmined that the Reactor Oversi ght Process (ROP) D eviation Memorandum d ated July 29, 2005, do es not need to be renew ed, and that S alem should receive a no rmal level o f NRC over sight , consis tent with the ROP Ac tion Matri
- x. W e have determined that the criteria for cl osure of the Dev iation M emorandum have been satisfied

Therefore, we pla n to conduct R OP baseline inspection s at your faci lity, w ith some insp ection samples focused on your specif ic actions to sustain improvements in SCW E.The enclosed inspection plan detai ls the insp ections, les s those relate d to physi cal protectio n, scheduled th rough March 3 1, 2008. The i nspection pl an is prov ided to al low for the re solution of any schedu ling conflicts and personnel availa bility issues w ell in a dvance of in spector arriv al onsit e. Rou tine r eside nt ins pecti ons ar e not l isted due to their ongoi ng and conti nuous nature. The inspection s in the l ast nine months of the inspecti on plan are tentative and may be revised base d on ou r end-of-cyc le saf ety pe rfo rma nce r eview.For your information, dur ing the evening of Septembe r 14, 2006, the NRC staff will be avail able to meet with members of the publ ic at a lo cation in the vici nity of the pl ant to discus s the proces s used to det ermine closu re of the substa ntiv e cross-cutti ng issu e in S CWE and retu rn to normal NRC oversight. The ti me and locati on of this informatio n session w ill be a vailabl e on the NR C we bsite , unde r "Pub lic M eetin gs."
