1.Theproposedprojectcreatesanunreasonable riskofharmtothehealthandsafetyofPetitioners andothermembersofthepublicduetothefollowing specificreasonsorbases:A.Applicants designfailstoresolvetheproblemofpumpflywheelmissilesgenerated bycoolantpumpoverspeed intheboilingwaterreactorswhichposesanunreasonable riskofharmtothehealthandsafetyofPetitioners andothers.Theelectrical brakingproposedbyApplicant isnotsufficient topreventthisproblem.B.Applicant failstoprovideadequateon-sitestoragefacilities initsdesigntosafelystorebothhighandlowlevelradioactive materials.
Thedisigncontemplates tempoxary storageon-siteoflowlevelmaterials, yetsincenoavenuesremainopenforapplicant todisposeofal1,radioactive waste,spentfuelandmaterials elsewhere, theApplicant mayhavetostorethespentmaterials longer,upto10to15years,,than itispreparedsafelytocontainandmonitorforsuchaperiodoftimeon-site.C.Applicant hasfailedtoprovide,ordemonstrate initsapplication, adequateplansforthesafetransportation inconnection withtheradioactive materials producedinconnection withtheoperation ofSusquehanna SteamElectricStation.D.Applicant's designfailstosolvetheproblemofflow-induced vibration inthecore,therebycreatingin-vessel spargerfailure.2.Applicants proposedfacilities creat+anunreasonable riskofharmtotheprivatepropertyofPetitioners andothermembersofthepubliclocatedwithin50milesoffacilities forallthereasonssetforinParagraph One,A-DofthisSupplement toPetition.3.petitioners andthePublicareexposedtounreasonable riskofharmtopersonalsafetyandpropertyduetotheprotection ofthePowerCompanyundertheFederalPrice-Anderson Actwhichlimitsitsliability.
4.Duetothefactsandcircumstances setforthinParagraph'-One, A-D,Applicants proposedfacilities violatethisCommission's Standards forprotection againstradiation setdownin10CFR20.1etseq.and10CFR20.105(a)whichpro-videsforpermissible levelsinunrestricted areasandtheenvironment aroundtheFacilities.
0page25.Applicants proposedFacilities areunreasonably costlyanduneconomical bothtoPetitioners andthepublicduetothefollowing reasonsandbases:A.Theoutputofelectricity tobeproducedbytheproposedfacilities, inre-lationtocost,willbelowerthanelectricity generated byexistingformsofenergyandtherefore moreexpensive toPetitioners andothers.B.Theprojected costoffacilities ofApplicant failstoaccountfor,orin-clude,theexpectedcostofdecommissioning thefacilities afteritsestimated usefullifeof30years.Suchcostisatleastequaltothecostofconstruction andwillbebornebyfutureconsumers andtaxpayers.
C.Thefacilities areunnecessary andwastefulastheelectriccapacityofPP&Lin1977was40%greaterthancustomerneedsanddemandsfromexistingfacilities.
Latestprojections'f energyuseandrequirements duringthenext30yearsforthePP8r.Lservicearea,theperiodequaltotheprojected plants"usefullife",showthatPPRLcanmeettheneedsofitscustomers throughexistingfacili-tiesandsourceswithoutinvesting inacostlyandunreasonably dangerous nuclearfacility.
D.Pennsylvania UtilityCommission regulations wouldpermitApplicant tobaseitsrates,inpart,according tocapital.investment infacilities, andtherebydoubleutilityratesforPPRLasitstotalinvestment forallfacilities willbedoubledaftercompletion oftheprojected facilities.
ThiscostwillbebornebylocalPPRLcustomers, yettheunneededelectricity willbesoldoutsideofthePPRLservicearea.6.TheApplicants failtoadequately.
