Appendix NOTICE OF VIOLATION Dairyland Power Cooperative License No. DPR-45 As a result of the inspection conducted on July 8-11, August 20, and August 30,1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions, (10'CFR Part 2, Appendix C), the following violation was identified:
Technical Specification 15.6.8.1.f for the Lacrosse plant states, in part,
" Written procedures.shall be established, implemented, and maintained covering
... Fire Protection Program implementation."
Section B.6.e. of the licensee's Appendix A response to the Branch Technical l Position 9.5-1 indicated that " Carbon dioxide (C0 2 ) extinguishing units are to i be' tested every five years in accordance with the Factory Mutual Handbook."
The written procedure for this requirement is located in the Fire Protection Program Implementation Procedure 6.5.
Contrary to the above, fire extinguishers were past due their required hydrostatic test schedule and had not been removed from service.
This is a Severity Level V violation (Supplement I.E.).
Pursuan't to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance: (1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
