Dear Mr. Rickard:

In Philadelphia Electric Company's October 6,1997, application as supplemented by letter dated February 2,1998, and your affidavit dated September 19,1997, and Mr. Ritterbusch's affidavit dated January 19,1998, the following documents were submltted and roquested that they be withheld from public disclosure pursuant to 10 CFR 2.790:

You indicated that the submitted proprietary information should be considered exempt from mandatory public disclosure for the following reasons:

1. The information sought to be withheld from public disclosure, is owned and has been held in confidence by Combustion Engineering, it consists of information concoming test data and methods for calculating Emergency Core Cooling System (ECCS) strainer sl e and design and fabrication details of ECCS strainers.
2. The information consists of test data or other similar data conceming a process, methc,d or component, the application of which results in substantial competitive advantage to Combustion Engineering.

The information consists of test data and methods for calculating ECCS strainer size and design and fabrication details of ECCS strainers, the application of which provides a competitive economic advantage. The availability of such information to competitors would enab'e them to modify their product to better compete with Combustion Engineering, take marketing of other actions to improve their product's position or impair the position of Combustion Engineering's product, and avoid developing similar data and analyses in support of their processes, methods or apparatus.

4. Use of the informa00n by competitors in the intemational marketplace would increase their ability to market nuclear steam supply systems by reducing the costs associated with their technology development in addition, disclosure would have an adverse teconomic impact on Combustion Engineering's potential for obtaining or maintaining foreign licensees.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.700 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercialinformation.

Therefore, MISC PENG CAL-059, Rev. 00; Drawing E 2007146-908-005, Rev. 01; and Drawing E 2007146-908-007, Rev. 01 submitted with Philadelphia Electric Company's October 6,1997, letter, as supplemented by letter dated February 2,1998, to the NRC, marked as proprietary, will be withheld from public disclosurr fursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concemed to inspect the documents if the need arises, we may send copies of this information to our consultants working in this area. We wil!, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
