UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Lawrence G. McDade, Chairman Dr. Michael F. Kennedy Dr. Richard E. Wardwell In the Matter of

ENTERGY NUCLEAR OPERATIONS, INC.

(Indian Point Nuclear Generating Units 2 and 3)

Docket Nos. 50-247-LR and 50-286-LR

ASLBP No. 07-858-03-LR-BD01 November 14, 2012 ORDER (Granting New York's Partially Unopposed Moti on for Leave to File Additional Exhibits)

On November 9, 2012, the State of New York (New York) filed a partially unopposed motion for leave to file additional exhibits concerning Contentions NYS-37 and NYS-5.

1 In that motion, New York requests that the Board admit four exhibits (NYS000447, NYS00448A/B, NYS000449, and NYS000450), which relate to Contentions NYS-5 and NYS-37.

2 The NRC Staff, Riverkeeper, Inc., and Hudson River Sloop Clearwater do not oppose the motion.

3 Entergy Nuclear Operations, Inc. (Entergy) does not oppose the admission of NYS00448A/B, NYS000449, and NYS000450, but opposes admission of NYS000447 at this time.

4 As grounds for its opposition, Entergy states that NYS000447 "has not been referenced in any NYS-37 1 Partially Unopposed Motion by State of New York for Leave to File Additional Exhibits Concerning Contentions NYS-37 and NYS-5 (Nov. 9, 2012) [hereinafter New York Motion].

2 Id. at 1. 3 Id. 4 Entergy's Answer to New York State's Motion for Leave to File Additional Exhibits on Contentions NYS-37 and NYS-5 (Nov. 12, 2012) at 1.

written or oral testimony" nor "has New York made any demonstration that it will be discussed during the upcoming supplemental NYS-37 hearing."

5 Therefore, Entergy requests that the Board defer its ruling until the supplemental hearing.

6 For good cause shown, 7 the Board GRANTS New York's motion for leave to file additional exhibits. However, Exhibit NYS000447 may be stricken at the supplemental hearing if found not to be relevant or within the scope of the proceeding. It is so ORDERED. FOR THE ATOMIC SAFETY AND LICENSING BOARD
