Dear Ms. Tierney,
I am writing to inform you that the U.S. Nuclear Regulatory Commission (NRC) isconsidering the issuance of a license amendment relating to the implementation of arevised Emergency Plan at the Vermont Yankee Nuclear Power Station (VY) to reflect thefact that all spent fuel will be moved into an onsite independent spent fuel storageinstallation (ISFSI) this year. The proposed amendment would replace the VY PermanentlyDefueled Emergency Plan and associated Emergency Action Level (EAL) Technical BasesDocument (hereafter referred to as the EAL scheme) with an ISFSI Emergency Plan andassociated ISFSI EAL scheme. NRC has completed a technical and regulatory review of the proposed VY ISFSIEmergency Plan and associated EAL scheme, and supporting documentation. We haveconcluded that the proposed VY ISFSI Emergency Plan and associated EAL schemecontinue to meet the standards in 10 CFR 50.47(b) and the requirements in Appendix E of10 CFR Part 50, as exempted. As such, the VY ISFSI Emergency Plan and associatedEAL scheme provides reasonable assurance that adequate protective measures can andwill be taken in the event of a radiological emergency. The basis for our conclusion iscontained in the attached draft safety evaluation prepared by the NRC staff. This license amendment application was noticed in the Federal Register on July 18, 2017(82 FR 32879).
