Dear Mr. Dopp:
The Intemational Atomic Energy Agency (IAEA) is conducting a long-term verification experiment at the Portsmouth site on the down blending of highly enriched uranium (HEU) materials in the X-326 Process Building. The United States Enrichment Corporation (USEC) forwarded the IAEA Safeguards and Security Plan to the Nuclear Regulatory Commission (NRC) for review on November 25,1997 (Reference 1). The NRC responded in Reference 2, which stated the NRC had no objection to the IAEA inspectors reviewing DOE classified National Security Information in USEC leased space subject to NRC regulations.' Reference 2 also stated that, since the IAEA inspectors are not conducting inspections in NRC certified space, they are not subject to the requirements of 10 CFR 95.36. However, they are subject to the commitments made in the NRC approved "Portsmouth Gaseous Diffusion Plant Security Plan for the Protection of Classified Matter" when handling classified information in USEC leased space subject to NRC regulations.
The IAEA has identified a need to observe the sampling and analysis of the low enriched uranium (LEU) UF. process flow by laboratory personnel in the X-710 facility as part of the experiment to verify that the HEU flow is in fact being down blended to a LEU flow. USEC believes that the i
intent of this additional activity is the same as that described in the plan forwarded to the NRC in Reference 1, and as~such does not constitute an inspection. USEC does want the NRC to be fully apprised of this additional activity and has provided a description of the activity (Addendum 3 to the l
DOE approved IAEA security plan) in Enclosure 1 for NRC's information.
