NiagaraMohawkhereinsubmitsresponsestoeachoftwoviolationsdescribedinNRCInspection86-08conductedattheNineMilePointUnitIFacilityonMay19-24,1986.tNoticeOfViolationItem150-220/86-04-03)TheInspectionReportstates:"10CFR20.201requires,inpart,thateachlicenseemakeorcausetobemadesuchsurveysthatarenecessaryandreasonabletocomplywith10CFR20.10CFR20.201definesasurveyas,amongotheritems,anevaluationoftheradiationhazardsincidenttothepresenceofradioactivematerialsand,whenappropriate,includesaphysicalsurveyofmaterialsandmeasure-mentsofconcentrationsofradioactivematerialpresent.10CFR20.103requiresamongotheritems,thatrespiratoryprotectionequipmentbeusedasspecifiedtherein.10CFR20.103alsorequirestheuseofengineeringcontrolstominimizeairborneradioactivityconcentrations.Contrarytotheabove,atabout4:30p.m.onMarch28,1986necessaryandreasonablesurveystoensurecompliancewith10CFR20.103werenotmadeduringlappingoperationson815dischargebypassvalve.Asaresultappropriaterespiratoryprotectionequipmentwasnotselectedandusedconsistentwith10CFR20.103(c)(1)requirements.Thetwoworkerslappingthevalvegeneratedairborneradioactivitywithapeakconcentrationofabout420timestheapplicableconcentrationspecifiedin10CFR20AppendixBexceedingtheprotectionfactor(50)ofrespiratorsusedbytheworkers.Inaddition,appropriateengineeringcontrols,asrequiredby10CFR20.103(b)(1),werenotused."8b082b0081Sb0814PDRADOCK050002208<DR
.aJi Pagy-2-NMP-19742NiagaraMohawkresponse:Inourreviewofthisviolation,weconcurthatthecausewastheinadequatecontaminationsurveyperformedpriortopermittingflappingoperationsonf115RecirculationLoopBypassvalve,thoughRadiationProtectionProcedureS-RP-3providesadequateinstructions.Asaresultofthis,thefollowingactionshavebeentakentopreventrecurrenceofanincidentofthisnature:AformalmemorandumwasissuedtoallUnitIRadiationProtectionTechni-cianson5/21/86describingthesurveyrequirementscontainedinS-RP-3relativetoinsuringadequateevaluationofcontaminatedsurfacespriortopermittingflappingorsimilaroperations.Inaddition,thememoran-dumprovidedinstructionsrelatedtodecontaminationactivities,fixedcontaminationassessmentmethods,criteriaforrequiringrespirators,andtheproperuseofengineeringcontrols.ThismemohasbeenreadandunderstoodbyalloftheaboveindicatedtechniciansinaccordancewithRadiationProtectionInstructionRPI-1.2.On5/21/86,aRadiologicalIncidentReport(RIR-21)wasissuedtosum-marizetheinvestigationofthisincidentincludingappropriatemeasurestopreventrecurrence.ThisRIRwascompletedon5/23/86.3.On5/23/86,RadiationProtectionInstructionRPI-1,"InHouseRadiationProtectionTechnicianReadingAssignmentsandTraining",wasrevisedtorequireChiefandBackshiftRadiationProtectionTechnicianstoread,understandandinitialthe"RPSupervisorLogBook"priortobeginningactivitiesonatourofduty.4.Thecontractortechnicianresponsiblefortheradiologicalcontrolofthisflappingoperationfailed'tofollowapprovedproceduresthatspecifysurveyrequirementsandconditionsrequiringtheuseofeachtypeofrespirator.Asacorrectivemeasure,thetechnicianwasdismissedfromthesiteandplacedon2yearprobationbyhisemployer.NoticeofViolationItem250-220/86-08-01)TheInspectionReportstaes:"10CFR19.12requiresinpart,thatallindividuals,workinginorfrequent-inganyportionofarestrictedareabeinstructedinprecautionsandpro-cedurestominimizeexposureandthepurposeandfunctionofprotectivedevicesemployed.Contrarytotheabove,onApril28,1986,twoworkers,performinggrindingandlappingoperationsinpreparationforreplacingreactorwaterclean-up'uctionvalve33-02(highlyradioactivelycontaminated),wereprovidedinadequateinstructionsfortheinstallation:anduseofaglovebag.Asaresult,airtoolswereusedwithinthe'ag."'Air'exhaustingintothebagcausedthebagtolose,itsintegritytherebysubjectingtheworkerstoairborneradioactivityconcentrationsofabout800.timestheapplicable10CFR20concentrationvalues.In.addition,-andasa.result,oneoftheworkerssustaineda,limitedunplannedintakeofairborneradioactivematerial."

~~Page-3-NMP-19742NiagaraMohawkresponse:l<ehavereviewedthedetailsofthisviolationandconcurwithyourgeneralfindingthatthecausecanbeattributedtotheinsufficiencyofoversightandcontrolofcontractors.Asaresultof.this,thefollowingcorrectiveactionshavebeencompletedtopreventrecurrenceofthisincident:1.SiteRadiationProtectionProcedureS-RP-2,"RadiationWorkPermitPro-cedure",and'-RP-7,"IncorporatingALARARequirementsintol(orkPlanningandInstruction";havebeenrevisedtorequirethatessentialjobradio-logicalcontrolsspecifiedbytheALARAReviewareincorporatedintotheRNPasaconditionforperformingthespecifiedwork.TheseprocedurerevisionsalsoincludedrequirementstoinsureuniformALARAradiologicalcontrolswereincorporatedintoRl(P'saswellasrequirementsstrengtheningtheoversightandcontrolofallstationradiologicalcontrol.activities.2.AreviewhasbeenperformedtoinsurethatallRadiationProtectionChiefTechniciansarecognizantofthememorandumissuedtothemon4/30/86concerningtheincorporationofessentialjobradiologicalcontrolsintoapplicableRl)P's.Thisreviewhasconcludedthatthesepersonnelhaveread,andunderstand,thememorandum.AllactiveRWP'sissuedpriortothisincidentwerereviewedandrevised,asapplicable,toinsureessential,jobradiologicalcontrolswereincorporatedintotheRl(Pasaconditionforthespecifiedwork.Inadditiontotheabovecompletedactions,additionalactionsarebeingtakenorevaluatedtofurtherreducethepotentialforincidentrecurrence.EachoftheseitemswillbecompletedbyDecember31,1986.1.Glovebagswillnotbeusedwithoutproperventilationandexhaust.Pro-ceduresforusehavebeendrafted.2.Thecontractor'sHealthPhysicsliasonpositionwillbeevaluatedtodeterminewhetheritaids,orinterfereswith,thecommunicationlinkbetweenNMPCRadiationProtectionandthecontractor.3.Thisconstructioncontractor'sperformanceisbeingreviewedrelativetocontinueduseinnuclearstationactivities.Insummary,webelievewehavetakenallpracticablecorrectiveactionstoinsuretheseviolationswillnotrecur.Ifthereareadditionalconcernsrelativetotheseactions,pleasenotifymyofficeorMr.EdLeachat315-349-2439.Verytrulyyours,ThomasEDLempgesVicePresidentNuclearGeneration 4),~~8S:i]]yGlgny888/""">>-m.~eg~
