SUBJECT: ASSESSMENT FOLLOW-UP LETTER FOR JAMES A. FITZPATRICK NUCLEAR POWER PLANT (REPORT 05000333/2015008)

Dear Mr. Sullivan:

On November 6, 2015, the U.S. Nuclear Regulatory Commission (NRC) completed its quarterly review of performance at the James A. FitzPatrick Nuclear Power Plant (FitzPatrick). The review included performance indicators (PI) and inspection results. This letter informs you of the NRC's assessment of your facility and supplements, but does not supersede, the mid-cycle letter issued on September 1, 2015.

The "Unplanned Power Changes per 7,000 Critical Hours" PI exceeded the Green-to-White threshold value in the fourth quarter of 2012. In the fourth quarter of 2014, the NRC completed a review of the White PI using Inspection Procedure 95001, "Supplemental Inspection for One or Two White Inputs in a Strategic Performance Area." The results of this inspection were documented in the fourth quarter integrated inspection report 05000333/2014005, dated February 6, 2015 (ADAMS Accession No. ML15037A280). The NRC concluded that the corrective actions taken were adequate to preclude repetition of the unplanned power changes and were sufficient to meet the inspection objectives. The NRC's review of FitzPatrick's performance identified that the "Unplanned Power Changes per 7,000 Critical Hours" PI returned to the nominal, expected range (i.e., Green) in the third quarter of 2015. Therefore, all inspection findings had very low (i.e., Green) safety significance, and all PIs indicated that your performance was within the nominal, expected range (i.e., Green). Accordingly, per the guidance in Inspection Manual Chapter 0305, "Operating Reactor Assessment Program," FitzPatrick transitioned to the Licensee Response Column (Column 1) of the NRC Reactor Oversight Process Action Matrix, effective October 1, 2015.

In accordance with Title 10 of the Code of Federal Regulations, Part 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRC's Agencywide Documents Access and Management System (ADAMS).
