= (OI) completed report regarding alleged discrimination at the St. Lucie Nuclear Plant against an employee for engaging in protected activities.

OI determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

- OI Investigation Information Case No. 2-2012-023 Enclosure SYNOPSIS

This investigation was initiated by the U. S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region II (RII), on May 10, 2012, to determine whether a former Florida Power and Light (FP&L) Site Excellence Plan Director was discriminated against for participating in a protected activity at the Saint Lucie Nuclear Plant (SLNP).

Based upon the evidence developed during this investigation, OI:RII did not substantiate that the former FP&L Site Excellence Plan Director was discriminated against for participating in a

protected activity at the SLNP.
