By letter dated February 9, 2017 (Agencywide Documents Access and Management System(ADAMS) Accession No. ML17045A140), Entergy Nuciear Operations, inc. (ENOI), on behalf ofItself and Entergy Nuciear Vermont Yankee, LLC (ENVY) and NorthStar NuciearDecommissioning Company, LLC (NorthStar) submitted an "Application for Order Consenting toDirect and indirect Transfers of Control of Licenses and Approving Conforming LicenseAmendment and Notification of Amendment to Decommissioning Trust Agreement" (Application)for the Vermont Yankee Nuciear Power Station (Vermont Yankee). The application wassubmitted in accordance with Section 184 of the Atomic Energy Act, Title 10 of the Code ofFederal Regulations (10 CFR) 50.80, and 10 CFR 72.50 for the direct and indirect transfers ofcontrol of ENOi's and ENVY's Renewed Facility Operating License No. DPR-28 for VermontYankee, as weii as the general license for the Vermont Yankee Independent Spent Fuel StorageInstallation. The proposed license transfer, and associated conforming administrative licenseamendments, would transfer the licensed possession, maintenance, and decommissioningauthorities to NorthStar in order to implement expedited decommissioning at the VermontYankee site.The purpose of this letter is to provide the results of the U.S. Nuciear Regulatory Commission(NRC) staff's acceptance review of the submittai. The acceptance review was performed todetermine if there is sufficient technical information in scope and depth to allow the NRC staff tocomplete its detailed technical review. The acceptance review is also intended to identifywhether the application has any readily apparent information insufficiencies in itscharacterization of the regulatory requirements or the licensing basis of the plant.The NRC staff has reviewed your application consistent with* 10 CFR Sections 50.80 and 72.50,and concluded that it does provide technical information in sufficient detail to enable the NRCstaff to complete its detailed technical review and make an independent assessment regardingthe acceptability of this request in terms of regulatory requirements and the protection of publichealth and safety and the environment. Given the lesser scope and depth of the acceptancereview as compared to the detailed technical review, there may be instances in which Issues A. Bakken that impact the NRC staff's ability to complete the detailed technical review are identified despitecompletion of an adequate acceptance review.
