COMSECY-21-0010: Revision of the Reactor Oversight Process Public Radiation Safety Significance Determination Process In this paper, the staff recommends updating the Significance Determination Process for the Public Radiation Safety Cornerstone of the Reactor Oversight Process to incorporate oversight of the Part 37 physical security requirements for Category 1 and Category 2 quantities of radioactive material. The proposed changes are risk-informed and based on inspection and enforcement experience. They are consistent with how the agency has handled the significance determination of recent transportation-related inspection findings. In addition, there is broad agreement across the agency that the changes are reasonable and appropriate, including from the Office of Nuclear Reactor Regulation, the Office of Enforcement, and the regional offices.
The proposed changes were well-vetted with interested stakeholders during public meetings and a public comment period. For these reasons, I approve the changes recommended by the NRC staff.
