Dear Ms. Elie:
I am responding to your letter to me dated February 4, 2008, regarding the filing of contentions on the Indian Point license renewal hearing process. The Atomic Safety and Licensing Board (ASLB) is currently meeting on the submitted contentions for Indian Point at the Richard J.
Daronco Courthouse, 111 Dr. Martin Luther King Boulevard, White Plains, New York. During this time, the ASLB is clarifying its understanding of the Petitioners contentions, and the NRC staffs and the Applicants (Entergys) responses thereto. The ASLB makes the final determination regarding which contentions are admissible for the proceeding; the NRC staff only provides its opinion regarding whether each contention is valid and admissible.
I noted that a number of nongovernmental organizations, such as Riverkeeper, Clearwater, and the Westchester Citizens Awareness Network (an organization which you have previously indicated you belong to), as well as the Town of Cortlandt, will be presenting information on their submitted contentions to the ASLB. I understand you have been attending the ongoing ASLB meetings and hope you will learn more about the ASLB hearing process.
