Dear Mr. Sipek:

1 By letter dated July 29,1998 (U-603047), Illinois Power (IP) requested exemptions to permit five individual reactor operator and senior operator trainees to receive conditional licenses.

Specifically, IP requested conditional licenses that would limit the individuals to operate the facility only in Mode 4, COLD SHUTDOWN, with the reactor mode switch in SHUTDOWN. It is the staff's understanding that because of the extended shutdown at Clinton Power Station these individuals have not had the opportunity to perform reactivity manipulations required by 10 CFR 55.31(a)(5), or operate the facility at a power level greater than 20%. IP provided additional information pertaining to the request by letter dated August 26,1998.

In response to IP's request, the staff reviewed the rulemaking record for the 1987 amendment to 10 CFR Part 55 that resulted in the 10 CFR 55.31(a)(5) requirement for reactivity manipulations. Based on this review, the staff determined that licenses limited to shutdown can be issued, given the conditions presented by IP at the Clinton Power Station, without tne need to issue an exemption.' Accordingly, the staff is proceeding to issue reactor operator and senior l

cperator licenses as appropriate, all of which will be limited to Mode 4, COLD SHUTDOWN, for the five individuals identified in your July 29,1998 request. These licenses will be issued following the staff's verification that all other applicable reactor operator licensing requirements have been met.
