MINUTES OF THE CRGR MEETING NUMBER 324 The Committee To Review Generic Requirements (CRGR) met on Tuesday, July 14,1998, from 9:00 a.m. to 12:00 p.m., to hold the Committee's 324* meeting. Attachment 1 contains the list of attendees.

R. Spessard (NRR) presented for the CRGR review and endorsement the safety evaluation report (SER) on Electric Power Research Institute Topical Report, TR-107330, " Generic Requirements Specification for Qualifying a Commercially Available PLC for Safety Related Applications in Nuclear Power Plants." CRGR asked the staff to clarify (1) in the letter to EPRI, concerning use of TR-107330, that it is the licensees' responsibility for determining whether the specific design incorporating the PLC can be implemented without prior NRC staff approval in accordance with the requirements of 10 CFR 50.59; and (2) in the SER accep!ing TR-107330, that use of numerical reliability / unavailability as a sole means of meeting NRC regulations is not acceptable. The staff provided satisfactory clarifications (Attachment 2-A), and the Committee endorsed the SER (Attachment 2-B).

G. Lainas (NRR) presented for CRGR review and endorsement the final SER and generic letter on the BWR Vessel and Internals Project, "BWR Reactor Vessel Shell Weld Inspection Recommendations"(BWRVIP-05). CRGR provided various comments and recommendations on both documents, and upon resolution of its comments the Committee endorsed both documents. Subsequently, the latter document was issued as Generic Letter 98-05. contains the briefing material used by the staff.

In accordance with the EDO's July 18,1983 directive conceming " Feedback and Closure of CRGR Review," a written response is required from the cognizant office to report agreement or disagreement with the CRGR recommendations in these minutes. The response is to be forwarded to the CRGR Chairman and if there is disagreement with the CRGR recommendations, to the EDO for decision making.

Subject:

Proposed Changes to Address CRGR Comments on EPRI PLC Topical Report TR-107330 Raji-Per this mornings CRGR meeting on EPRI Topical Report TR-107330 concerning the requirements specification for PLCs, I propose the following wording changes to address the CRGR comments on the two items identif:ed in the meeting as follows:

l. Clarification in the letter to Joseph Nas:r, EPRI concerning use of TR-107330 in licensee 10 CFR 50.59 reviews.

We will add the following sentences to the end of the second paragraph on page 2 of the letter-

"For plant specific applications, the licensee is responsible for determining whether the specific design incorporating the PLC can be implemented without prior NRC staff approval in accordance with the requirements of 10 CFR 50.59. NRC staff approval of EPRI TR-107330 does not provide this determination."

2. Clarification in the staff SER accepting FR-107330 on use of numerical reliability / unavailability as a sole means of meeting NRC regulations.

We will add the following sentence to the eid of the paragraph at the top of page 15 which began on page 14 of the SER "Use of numerical reliability / unavailability for sofware-based systems is not acceptable as a sole means of meeting h RC requirements because software-based system failures are not random."

Please let me know if these changes are ok end we will proceed to revise the document and issue the SER. Ifyou have any questions, let me know.

CRGR ENDORSEMENT OF THE EPRI PLC TOPICAL REPORT To: Lee Spessard, NRR On July 14,1998, at the CRGR Meeting No. 324, the Committee reviewed the SER on EPRI Topical Report TR-107330. Subsequently, via an e-mail, dated July 14th (copy enclosed), the CRGR staff received the staffs proposed clarifications. The proposed wording related to two items appear to adequately address the Committee's comments and recommendations. With these clarifications, the Committee's endorses the SER.

This e-mail along with the enclosure will be the only communication on the subject.
