Billie Pirner Garde, Esquire Government Accountability Project Midwest Office IN RESPONSE REFER 4

104 E. Wisconsin Avenue TO F01A-86-A-98 l

Appleton, WI 54915-8605 (FOIA-85-59)

Dear Ms. Garde:

This is in further response to your letter dated June 23, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated May 22, 1986~, which denied occuments in whole or in part that were subject to your Freedom of Information Act (FOIA) request for documents related to the NRC t

Comanche Peak Task Force. My letter to you dated April 10,1987, addressed the agreement which was the basis for deleting certain

)

information in the requested documents. This letter will address those portions of 85 documents listed on Appendix H which were initially denied

{

pursuant to an FOIA exemption.

I j

Acting on your appeal, I have carefully reviewed the record in this case and have determined that the previously withheld information in the 85 documents will continue to be withheld from public disclosure pursuant i

toExemption(5)oftheFOIA(5U.S.C.552(b)(5))and10CFR9.5(a)(5) j of the Commission's regulations. Your appeal is, therefore, denied.

~

i As stated in Mr. Grimsley's letter dated May 22, 1986, the withheld portions of these 85 documents relate to the subject of potential violations. The withheld portions were predecisional to the issuing of the enforcement action on Comanche Peak.

Exemption (5) shields from L

mandatory disclosure information generated in the deliberative process j

that precedes most decisions'of government agencies.

i This is a final agency action. As set forth in the FOIA (5 U.S.C.

(

552(a)(4)(B)) Judicial review of this decision is available in a I

district court of the United States in the district in which you reside, j

have your principal place of business, or in the District of Columbia, i

Sincerely, l

Docket Nos. 50-445/50-446 Ms. Billie Pirner Garde. Director Environmental Whistleblower Clinic Government Accountability Project l

1555 Connecticut Avenue, NW, Suite 202 IN RESPONSE REFER l

Washington, DC 20036 TO F0!A-85-59

Dear Ms. Garde:

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984.

We are now placing into the NRC Public Document Room (PDR) one additional box of records (box number seven) in the QA/QC category, covering Appendix H records numbered 1 through 257.

Portions of the records identified at numbers 79 through 93, 95 through 98,100 through 112, 145 through 149, 199 f

through 201, 203 through 236, 238 through 247, and 249 are being withheld from public disclosure and 10 CFR 9.5(a)(pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5))

5) of the Comission's regulations. The withheld portions contain the advice, opinions, and recommendations of the staff concerning potential violations. The nonexempt portions of the Appendix H records are being placed in POR file F01A-85-59 under your name.

We are not disclosing the records identified at numbers 2,125 through 128, 136 through 139,141,142,152,162, and 253 and portions of the records identified at 4 through 9, 14, 15, 18 through 22, 75 through 79, 94, 99, 106, 111, 125 through 135, 140, 202, 211, 213, 216, 225, 233, 234, 236, 237, 240 through 243, 245, 248, and 249. We are not invoking an FOIA exemption regarding these records in light of the agreement reached between you and the NRC staff at a meeting held on May 8,1985. This agreement was sumarized in a letter to you from Joseph M. Felton, dated May 15, 1985. The information that has been deleted from these records consists of names and other identifying information concerning allegers, interviewees, and other individuals.

i Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld pursuant to Exemption (5) of the FOIA is exempt from production or disclosure and that its production of disclosure is contrary i

to the public interest.

The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director Office of Nuclear Reactor Regulation.

This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations. U.S. Nuclear Regulatory Comission. Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
