RESPONSE TO NRC LETTER REGARDING DOE /NRC FORMS 741 AND 742 NRC letter dated February 27, 1988 stated that the DOE /NRC/741 forms do not contain information at the level of detail which would allow NRC to deem the information as commercial or financial information within the meaning of 10CFR2790(d).
It was also stated that additional information could be provided in order to have the previous position reconsidered. Consumers Power Company is providing the following additional information in order to further clarify the confident-iality of information contained on DOE /NRC forms 741 and 742:
- 1. Form 741s and 7428 submitted for the semiannual Material Status Reports do not contain explicit proprietary information relative to Consumers Power or its equipment vendors or suppliers.
- 2. Form 741s containing information on special nuclear material directly traceable to vendor products intended for use at Consumers Power Company facilities (eg, fuel assemblies, enriched UO2 powder, neutron sources, etc) are considered to contain proprietary information of the product vendor and should not be made publicly available. This viewpoint was made known to the NRC by our fuel vendor, ANF, in a letter to CEMacDonald Chief, Transportation Branch dated July 22, 1987.
- 3. Form 741s containing information on special nuclear material in pre-processed form (eg, enriched UF6) reflect final fuel enrichments and amounts that are used to fabricate final products for use at Consumers Power Company facilities. Therefore, as a minimum, the material weights (element and isotope) and enrichments are considered proprietary to the product vendor and should not be made publicly available.
