On February 7, 2006, the NRC staff completed its performance review of Oyster Creek Generating Station (Oyster Creek). Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from January 1 through December 31, 2005. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.
This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as Official Use Only - Security-Related Information will include the physical protection review and resultant inspection plan.
Overall, Oyster Creek operated in a manner that preserved public health and safety and fully met all cornerstone objectives. Plant performance for the most recent quarter was within the Regulatory Response column of the NRCs Action Matrix, based on one inspection finding being classified as having low to moderate safety significance (White) in the Emergency Planning (EP) Cornerstone and all PIs indicating performance at a level requiring no additional NRC oversight (Green). The White finding, documented in a letter dated January 9, 2006, involved Oyster Creek staff not recognizing that plant parameters met emergency action level (EAL) thresholds during an event in August 2005.
Looking back, safety performance for Oyster Creek was in the Degraded Cornerstone Column of NRCs Action Matrix in the third quarter 2005, based on a previously identified White inspection finding in the EP Cornerstone overlapping the current White finding. This previous finding involved an inadequate EP event classification procedure, which was closed in an inspection report issued July 15, 2005. In May 2006, the NRC plans to conduct a 95002 supplemental inspection to evaluate the effectiveness of your corrective actions to address performance in the EP Cornerstone.
In our mid-cycle assessment letter, dated August 30, 2005, we advised you of the continuation of a substantive cross-cutting issue in the area of problem identification and resolution (PI&R).
During this assessment period, there were six inspection findings that were attributable, at least in part, to weaknesses in PI&R. Based on the findings not sharing a common performance theme, and that in general, you have demonstrated timely and effective corrective actions following implementation of program improvements in June 2005, we have concluded that the

In summary, Oyster Creek was operated safely and is currently in the Regulatory Response column of the NRCs Action Matrix. The NRC closed the PI&R substantive cross-cutting issue, which had been open for calendar year 2005.
The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through September 30, 2007. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the mid-cycle review.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

ANNUAL ASSESSMENT LETTER - OYSTER CREEK GENERATING STATION (REPORT 05000219/2006001)

Dear Mr. Crane:

On February 7, 2006, the NRC staff completed its performance review of Oyster Creek Generating Station (Oyster Creek). Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from January 1 through December 31, 2005. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as Official Use Only - Security-Related Information will include the physical protection review and resultant inspection plan.

Overall, Oyster Creek operated in a manner that preserved public health and safety and fully met all cornerstone objectives. Plant performance for the most recent quarter was within the Regulatory Response column of the NRCs Action Matrix, based on one inspection finding being classified as having low to moderate safety significance (White) in the Emergency Planning (EP) Cornerstone and all PIs indicating performance at a level requiring no additional NRC oversight (Green). The White finding, documented in a letter dated January 9, 2006, involved Oyster Creek staff not recognizing that plant parameters met emergency action level (EAL) thresholds during an event in August 2005.

Looking back, safety performance for Oyster Creek was in the Degraded Cornerstone Column of NRCs Action Matrix in the third quarter 2005, based on a previously identified White inspection finding in the EP Cornerstone overlapping the current White finding. This previous finding involved an inadequate EP event classification procedure, which was closed in an inspection report issued July 15, 2005. In May 2006, the NRC plans to conduct a 95002 supplemental inspection to evaluate the effectiveness of your corrective actions to address performance in the EP Cornerstone.

In our mid-cycle assessment letter, dated August 30, 2005, we advised you of the continuation of a substantive cross-cutting issue in the area of problem identification and resolution (PI&R).

During this assessment period, there were six inspection findings that were attributable, at least in part, to weaknesses in PI&R. Based on the findings not sharing a common performance theme, and that in general, you have demonstrated timely and effective corrective actions following implementation of program improvements in June 2005, we have concluded that the

In summary, Oyster Creek was operated safely and is currently in the Regulatory Response column of the NRCs Action Matrix. The NRC closed the PI&R substantive cross-cutting issue, which had been open for calendar year 2005.

The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through September 30, 2007. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the mid-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
