                                                )             ASLBP No. 06-845-01-EA NRC STAFFS APPLICATION FOR THE ISSUANCE OF A SUBPOENA TO CHARLES DAFT INTRODUCTION Pursuant to 10 C.F.R. § 2.702(a) of the Commissions regulations, the Staff of the Nuclear Regulatory Commission (Staff) requests that the Atomic Safety and Licensing Board (Board), designated in the above-captioned proceedings, issue a subpoena, attached hereto, requiring Charles Daft, to attend and give testimony at a deposition.
DISCUSSION The Staff requests the Board to issue a subpoena for Charles Daft in order to ensure the Staffs ability to depose this individual on the date specified. Mr. Dafts testimony is relevant to the issues raised by this enforcement proceeding. In 2001, Mr. Daft was a Staff Nuclear Engineer at Davis-Besse. In the Fall of 2001, Mr. Daft was asked to review CD-ROMs of Davis-Besses twelfth refueling outage (12RFO) head inspection and capture pictures of nozzles. Davis-Besses October 30, 2001, submittal to the NRC (Serial 2744) contained pictures of nozzles captured from Davis-Besses 12 RFO inspection CD-ROMs. Mr. Daft was also involved in the initial response to the Bulletin (Serial 2731).
