On April 4, 2006, the Region I Field Office, NRC Office of Investigations (OI) initiated aninvestigation (Case No. 1-2006-024) to determine whether an Instrument and Control (I&C)
Technician was discriminated against for engaging in NRC protected activity, specifically, initiating action requests in the corrective action program and raising concerns through the Employee Concerns Program. Documentary and testimonial evidence developed by OI did not support that the technician wasdiscriminated against for having engaged in NRC protected activity. Rather, OI found that the technician demonstrated somewhat erratic and unusual behaviors, and that in accordance with NRC fitness for duty requirements, PPL took appropriate actions (such as requiring the technician to undergo independent medical evaluations), which led to the denial of the technician's unescorted access.Please note that final NRC investigation documents, such as the OI report described above,may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.Also, in accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter willbe available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
