ACCEPTANCE FOR REVIEW OF NUCLEAR ENERGY INSTITUTE TOPICAL REPORT MATERIAL RELIABILITY PROGRAM (MRP): TECHNICAL BASIS FOR PREEMPTIVE WELD OVERLAYS FOR ALLOY 82/182 BUTT WELDS IN PRESSURIZED WATER REACTORS (MRP-169) (TAC NO. MD 8005)

Dear Mr. Riley:

By letter dated September 7, 2005 (Agencywide Documents and Access Management System Accession (ADAMS) Accession No. ML052520325), the Nuclear Energy Institute submitted for

U.S. Nuclear Regulatory Commission (NRC) staff review Topical Report (TR) Material Reliability Program (MRP): Technical Basis For Preemptive Weld Overlays For Alloy 82/182 Butt Welds In Pressurized Water Reactors (MRP-169). In a letter to the NEI dated April 26, 2007, the NRC discontinued its review of MRP-169 (ADAMS Accession No. ML071130113). After an August 23, 2007, pre-submittal meeting with the NRC staff, the NEI and the Electric Power Research Institute (EPRI) indicated that they would submit the necessary documentation to re-initiate the NRC's review of MRP-169. By letter dated January 9, 2008, the NEI re-submitted for NRC staff review TR MRP-169 (ADAMS Package No. ML080780312).

The NRC staff has performed an acceptance review of the TR MRP-169. We have found that the material presented is sufficient to begin our comprehensive review. The NRC staff expects to issue its request for additional information by April 30, 2008, and issue its draft safety evaluation by August 22, 2008. The NRC staff estimates that the review will require approximately 250 staff hours including project management time. The review schedule milestones and estimated review costs were discussed and agreed upon in a telephone conference between Mike Melton, Senior Project Manager, and the NRC staff on March 18, 2008.

In accordance with the letter dated August 2, 2006 (ADAMS Accession No. ML061950468), the fee branch has waived the Section 170.21 of Title 10 of the Code of Federal Regulations fees associated with this TR review.
