Letter from Michael P. Gallagher (Exelon Generation Company, LLC) to U.S. Nuclear Regulatory Commission, "Certification of Permanent Cessation of Power Operations," dated June 20, 2016 (ML 16172A137)
Pursuant to 10 CFR 50.90, "Application for amendment of license or construction permit," Exelon Generation Company, LLC (EGC) requests an amendment to Facility Operating License Number NPF-62 for Clinton Power Station (CPS). The proposed amendment would revise the site emergency plan (SEP) and Emergency Action Level (EAL) scheme for the permanently defueled condition.
The proposed changes are being submitted to the NRC for approval prior to implementation, as required under 10 CFR 50.54(q)(4).
On June 2, 2016, EGC announced that it plans to close the CPS, Unit 1 due to deteriorating economics.
As announced, EGC agreed to permanently cease operations at CPS on June 1,2017. In the referenced letter, EGC provided formal notification to the U.S. Nuclear Regulatory Commission (NRC) of EGC's intent to permanently cease power operations at CPS on June 1, 2017. Once the certifications for permanent cessation of power operations and permanent removal of fuel from the reactor vessel are submitted to the NRC in accordance with 10 CFR 50.82(a)(1
)(i) and (ii), pursuant to 10 CFR 50.82(a)(2), the 10 CFR 50 license for CPS will no longer authorize operation of the reactor or placement or retention of fuel in the reactor vessel. The proposed SEP changes will revise the on-shift staffing, the Emergency Response Organization (ERO) staffing, and the EAL scheme. EGC has reviewed the proposed August 11, 2016 U.S. Nuclear Regulatory Commission Page 2 changes against the planning standards in 10 CFR 50.47(b) and requirements in 10 CFR 50, Appendix E and concludes that the standards and requirements will continue to be met. The proposed changes to the SEP are commensurate with the reduced spectrum of credible accidents in the permanently defueled condition.
In order to assist in the transition from an operating facility to a permanently defueled facility, the changes are required to properly reflect the conditions of the facility while continuing to preserve the CPS Decommissioning Trust Fund for its intended function for decommissioning and maintain the effectiveness of the CPS SEP. The description and evaluation of the proposed SEP changes are contained in Attachment
: 1. Attachment 2 provides a tabular summary of the proposed changes to the SEP, including the proposed changes for the EAL scheme. Attachment 3 provides the revised pages of the SEP with the proposed changes. Attachment 4 provides the revised pages of the SEP Annex with proposed changes. Attachment 5 provides the analysis of Emergency Response Organization (ERO) tasks that will be transferred to remaining ERO positions.
Attachment 6 of this letter contains new regulatory commitments.
A meeting was held with the Illinois Emergency Management Agency (lEMA) and the primary affected county for CPS (DeWitt County) at the DeWitt County Emergency Operations Center (EOC) in Clinton, IL on July 14, 2016. The proposed changes to the CPS Emergency Plan were presented to the Illinois Emergency Management Agency and the DeWitt County Emergency Management Agency. Specifically, the reviews were to identify any potential impact on the State's Radiological Emergency Response Plan (RERP). Attachment 7 contains a letter from Joseph G. Klinger, Assistant Director, Illinois Emergency Management Agency to Chris Propst, Director, Site Decommissioning Transition Organization, Clinton Power Station, dated August 1, 2016 confirming that lEMA "has performed a preliminary review" of the Clinton License Amendment Request. The proposed changes have been evaluated in accordance with 10 CFR 50.91 (a)(1) using criteria in 10 CFR 50.92(c), and EGC has determined that this change involves no significant hazards consideration.
EGC has also determined that the proposed SEP changes satisfy the criteria for categorical exclusion in accordance with 10 CFR 51.22(c)(9) and do not require an environmental review. Therefore, pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment is required.
The proposed change has been reviewed by the CPS Plant Operations Review Committee in accordance with the requirements of the EGC Quality Assurance Program. EGC requests review and approval of the proposed license amendment by April4, 2017, to support the current schedule for the CPS transition to a permanently defueled facility.
Once approved, the amendment shall be implemented within 60 days from the effective date of the amendment.
EGC requests that the approved amendment become effective following the docketing of the certifications required by 10 CFR 50.82(a)(1) that CPS has been permanently shutdown and defueled.
