oral argument on New York's motion was held on May 14, 2015. Westinghouse Electric Co., LLC has requested leave to enter a special appearance on this issue. Written briefs are to be filed by Entergy/ Westinghouse on June 4, by New York on June 18, and by the Staff on June 25, 2015. 2. Other Safety Issues.

The Staff is reviewing issues associated with two recent Interim Staff Guidance ("ISG") documents (LR-ISG-2012-02 and LR-ISG-2013-01).11 The Staff has not yet determined whether these matters will be addressed in an SER Supplement.

The Staff will provide further information to the Board regarding these issues when available.

Environmental Issues

3. FSEIS Supplement. As stated previously, the Staff intends to issue a second supplement to the Final Supplemental Environmental Impact Statement

("FSEIS") for license renewal of IP2 and IP3

,12 which will address new information received by the Staff since preparation and publication of the previous FSEIS Supplement (FSEIS Vol. 4) in June 2013. -35/36. On July 14, 2011, the Board issued LBP 17, granting summary disposition on Contention NYS

-35/36 (Implementation of Cost-Beneficial SAMAs) in favor of New York.16 On February 18, 2015, the Commission granted the Staff and Entergy's petitions for review of the Board's rulings on Contention NYS

-35/36, and instructed the Staff to respond to four questions related thereto.17 In accordance with the Commission's Order, the

, that it was submitting the information "to support resolution of certain issues identified by the Board" in LBP-11-17. .20 As stated previously, the Staff plans to present its evaluation of the Applicant's revised SAMA cost information in the upcoming draft FSEIS Supplement

5. Contention NYS

-12C (SAMAs). On February 14, 2014, New York filed a petition for Commission review of the Board's decision in LBP 13,23 concerning its resolution of Contention NYS

-12C;24 on April 28, 2014, New York filed a petition for review of the Board's Order denying its motion to reopen and reconsider that decision

.25 On February 18, 2015, the Commission gra nt ed New York's petition for review and direct ed the parties to respond to eight related questions.26 In accordance with the Commission's Order, initial briefs were filed by the Staff, Entergy

, New York , and the State of Connecticut on March 30, 2015; reply briefs were filed by the Staff, Entergy and New York on April 29, 2015

. 6. CZMA Issues. To the best of the Staff's knowledge, information and belief, the current status of CZMA

-related issues is as follows.

(a) Previous Reviews. On June 12, 2013, the Board denied the Applicant's and New York's motions seeking the entry of a declaratory order regarding Entergy's claim that New York had previously conducted a review of IP2/IP3 for consistency with the New York State Coastal Management Program

. On December 6, 2013, the Staff transmitted a request for information to NYSDOS regarding prio r reviews of Indian Point's consistency with the New York State Coastal Management Program

(b) Grandfathering. O n December 11, 2014, the State of New York Supreme Court, Appellate Division

, Third Judicial Department

, reversed the Supreme Court's December 2013 decision, and held (in a 5

-0 decision) that Indian Point Units 2 and 3 were "grandfathered" under New York's Coastal Management Program and are therefore exempt from consistency review under the CMP

.34 On April 6, 2015, New York file d a motion before the New York Court of Appeals, seeking leave to appeal the Appellate Division's decision; the Staff understands that the Court of Appeals has not yet ruled on New York's motion.

. (c) 2012 Consistency Certification. On December 17, 2012, Entergy filed a certification with the NYSDOS, asserting that license renewal of IP2/IP3 is consistent with the New York CMP; NYSDOS then commenced a review of that consistency certification.

O n November 5, 2014, Entergy submitted a letter to NYSDOS, stating that it was withdrawing its consistency determination, subject to resubmittal following issuance of the Staff's Final FSEIS Supplement in March 2016

.35 In response, NYSDOS stat ed that the withdrawal was not effective and it offer ed Entergy an opportunity to request a stay of NYSDOS

's decision;36 Entergy replied to NYSDOS on December 1, 201 4.37 NYSDOS and Entergy have entered into an agreement deferring New York's review of Entergy's consistency certification until June 30, 2015; absent 34 Entergy Nuclear Operation, Inc. v. New York State Department of State

. 4).40 The Staff transmitted a request for additional information to the Applicant on August 28, 2014

8. Endangered and Threatened Species. On April 2, 2015, the U.S. Fish and Wildlife Service published a final rule listing the northern long

-eared bat as threatened throughout its range, which includes the Indian Point site.45 On April 22, 2015, the Staff transmitted RAIs to Entergy concerning the northern long

-eared bat; Entergy's response is expected on June 8, 2015.46 9. Other Matters. The Staff is not currently aware of any other matter that has the potential to impact the schedule for hearings in this proceeding.
