SUSPENSION OF LICENSES XSNM01906 AND XSNM02773 The purpcse of this letter is to confirm information recently provided to you by telephcne concerning the suspension of certain NRC export licenses.

The U.S.-Switzerland Agreement for Cooperation in the Peaceful Uses of Nuclear i

Energy expired on August 7, 1996. Negotiations on a new agreement are underway, but have not been completed.

In the meantime, the NRC is without authority under U.S. law and regulations to authorize exports of special nuclear material to Switzerland. Any such export without an agreement for cooperation being in effect would v'.olate the Atomic Energy Act.

General Electric holds two NRC licenses which are affected, XSNM01906 and XSNM02733.

You have informed us that all shipments under XSNM02733 have been completed and thus suspension, or termination, of the license is of no consequence to the comphny. However, General Electric has not shipped all of the material authorized for export under license XSNM01906 and would wish to continue exporting under it when this again becomes possible.

You have informed us in a letter dated September 9,1996 that General Electric will not use this export license until NRC has advised you in writing that a new agreement for cooperation is in force and the U.S. has received the necessary assurances from Switzerland.

With the expiration of the U.S. - Switzerland Agreement for Cooperation in the Peaceful Uses ofNuclear Energy on August 7,1996, General Electric Company has not made any shipments using the subject licenses.

As the shipment covered by XSNM02773 has been completed, please expire that license.

We will wish to continue exponing under license XSNM01906 once a new agreement for j

cooperation is in force, however, until we have been notified in writing by the NRC we j

l will not make any shipments under license XSNM01906. We will comply with the l

suspension of all applicable expons to Switzerland.

Enclosed is a letter dated November 7,1995 from General Electric Company requesting an amendment to export license XSNM01906. The license involves the export of LEU to ENUSA in Spain for fuel fabrication and ultimate use as reload fuel in the Muhleberg nuclear power plant in Switzerland.

The licensee has requested an amendment to the license to change the name of l

the ultimate consignee in Switzerland; however, since the intermediate l

consignee is in Spain, we will need new assurances from EURATOM that the material while in Spain, will be subject to the terms and conditions of the l

U.S./ EURATOM agreement for cooperation.

Your assistance in obtaining the necessary assurances from EURATOM would be greatly appreciated. We are attaching a copy of the latest amendment to this license and a copy of EURATOM assurances dated April 1, 1993 to facilitate the request for assurances.-
