The Enforcement Manual, 7.5.4.2b, provides that if no differing views have been received by OE following the "three-week memo" proposing no enforcement action, the office that requested the investigation should send a letter to the licensee notifying them that they are no longer under investigation and that no enforcement action is being proposed.

This letter should include a copy of the synopsis of the 01 report.

The fact that the 01 report does r.ot substantiate wrongdoing does not mean that the matter is closed.

On the staff's request. 01 may da additional investigating, in which case, the disclosure of the synopsis may adversely impact the investigation.

Please ensure that the 01 synopsis is not made public until the 01 case is closed and the time frame set out in the OE memo has expired without comment from another office.
