ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or around January 11, 2002, to Exelon Nuclear as a result of inspections at the Limerick Unit 2 Generating Station. This White finding, an issue with low to moderate increased importance to safety that may require additional NRC inspections, concerned Exelons failure to have adequate measures in place to identify that the 2N Safety/Relief Valve (SRV) was in a degraded condition and was vulnerable to a failure to re-close after lifting. The NRC determined that a violation of 10 CFR 50, Appendix B, Criterion XVI existed due to the licensees failure to identify the extent of the valves degraded condition.

The licensee declined an opportunity to participate in a regulatory conference on this issue.
