We have reviewed the final revisions to the Utah Radiation Control Rules, Utah Administrative Code R313-12, R313-19, R313-21, and R313-22, received by our office on November 30, 2017. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2013-2 and other provisions to Title 10 of the Code of Federal Regulations Part 40 not associated with a RATS ID as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Rusty Lundberg on January 11, 2018.
We have reviewed the final revisions to the Utah Radiation Control Rules, Utah Administrative Code R313-12, R313-19, R313-21, and R313-22, received by our office on November 30, 2017. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2013-2 and other provisions to Title 10 of the Code of Federal Regulations Part 40 not associated with a RATS ID as identified in the enclosed State Regulation Status (SRS) Data Sheet. As a result of our review, we have five comments that have been identified in the enclosure.

We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
Please note that we have limited our review to regulations required for compatibility and/or health and safety. Dear Mr. Anderson:

We have reviewed the final revisions to the Utah Radiation Control Rules, Utah Administrative Code R313-12, R313-19, R313-21, and R313-22, received by our office on November 30, 2017. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2013-2 and other provisions to Title 10 of the Code of Federal Regulations Part 40 not associated with a RATS ID as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Rusty Lundberg on January 11, 2018.

As a result of our review, we have five comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Utah, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Utah regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. R313 13(1)(c)(vii) 40.13(c)(7)(i) 2013-2 B

Unimportant quantities of source material In R313-19-13(1)(c)(vii)(A), Utah omitted the word mirror. Utah needs to add the word mirror so that the regulation reads as follows: The shaping, grinding or polishing of such lens or mirror or manufacturing processes other than the assembly of such lens or mirror into optical systems and devices without any alteration of the lens or mirror.

In R313-19-13(1)(c)(vii)(B), Utah omits the word uranium. Utah needs to add the word uranium so that the regulation reads as follows, The receipt, possession, use, or transfer of uranium or thorium contained in contact lenses, or in spectacles, or in eyepieces in binoculars or other optical instruments.

Utah needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 40.13(c)(7)(i).

2 R313 13(1)(c)(ix) 40.13(c)(10)(i) 2013-2 B

Unimportant quantities of source material In R313-19-13(1)(c)(ix), Utah omits the effective date of the regulations.

Utah needs to add the effective date.

In R313-19-13(1)(c)(ix)(B), Utah needs to reference NRC regulations as follows, A person authorized to manufacture, process, or produce these materials or products containing source material by an Agreement State, and a person who imports

Utah needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 40.13(c)(10)(i).

3 R313 21(2)(a) to (2)(c) 40.22 (b)(1-3) 2013-2 B

Small quantities of source material Utah omits references to certain Part 40 requirements in their equivalent regulations to 10 CFR 40.22(b). Utah needs to revise their regulations to read, Is subject to the provisions in 10 CFR 40.2a through 40.4; 10 CFR 40.41(a) (b) and (c); 40.46; 40.51(a),

(b)(1)-(5), (b)(7), (c) and (d); 40.60(a)

(b) (c)(1) and (2); and 40.61(a) (b) (d)

(e) and (f), which are incorporated by reference in Section R313-24-4, Section R313-12-3, Section R313 5, Section R313-19-34, Subsection R313-22-34(2), Section R313-19-41, Section R313-19-50, Section R313-15-1111, Sections R313-12-51 through R313-12-53, Section R313-19-61, and Rule R313-14.

Utah needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 40.22(b)(1-3).
