program inspection at your McGuire Nuclear Station. The enclosed report documents the
inspection results, which were discussed with Mr. Regis Repko, and other members of your

compliance with the Commissions rules and regulations, and with the conditions of your

McGuire Nuclear Station.

This report also documents one licensee-identified violation involving a failure to conduct an
inventory of special nuclear material as required by 10 CFR 74.19(c) and licensee procedure.
Because the violation met the criteria established by EGM 07-002, Enforcement Guidance
Memorandum-Interim Guidance for Dispositioning Violations of 10 CFR 74.19(c); it was self-
identified; it was corrected; and, all physical inventories of special nuclear material after
November 26, 2005, were adequate, I have been authorized, after consultation with the
Regional Administrator, Region II, to exercise enforcement discretion in accordance with
Section VII.B.6 of the Enforcement Policy and refrain from issuing enforcement action for the
violation.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be
available electronically for public inspection in the NRC Public Document Room or from the
Publicly Available Records (PARS) component of NRCs document system, ADAMS. ADAMS
is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public
Electronic Reading Room). However, because of the security-related concerns contained in the
enclosure, and in accordance with 10 CFR 2.390 a copy of this letters enclosure will not be
available for public inspection.
