Byrne (NMPNS) to NRC, Clarification Regarding Use of Supplemental Responders and Commitments to Incorporate Number of Supplemental Responders in the Security Plan, dated February 16, 2006 Pursuant to the requirements of NRC Order EA-06-037 (Reference a) and 10 CFR 50.5 4 (p), transmitted herewith are changed pages for Issue 6, Revision 1, of the Nine Mile Point Nuclear Station Physical Security, Safeguards Contingency and Security Training and Qualification Plan (the Plan). The Order require. an Answer within 21 days, which was provided in Reference (b). In that Answer, Nine Mile Point Nuclear Station, LLC (NMPNS) consented to the Order. Further, the Order required that NMPNS notify the Commission when the Order has been fully implemented, but no later than 60 days from the date of the Order. This letter serves to notify the Commission that the Order has been fully implemented, and provides the revised Plan pages as also required by the Order. This Plan revision also incorporates changes recommended in the NRC/Nuclear Energy Institute (NEI) joint resolutions of Security Frequently Asked Questions (SFAQ) 04-09 and 05-03, and corrects an editorial error within Section 7.4 of Appendix C to the Plan. Incorporation of the Plan changes consistent with SFAQ 05-03 satisfies the NOTE: THE ATTACHMENTS TO THIS LETTER CONTAIN "SAFEGUARDS INFORMATION" AND MUST BE PROTECTED ACCORDINGLY. UPON REMOVAL OF THE ATTACHMENTS, THIS LETTER IS "DECONTROLLED."

Document Control Desk April 26, 2006 Page 2 commitment contained in Reference (c). A summary of changes is provided in Attachment (1) and the revised pages of the Plan are provided in Attachment (2). Both attachments are classified as Safeguards InformE.tion.

NMPNS has reviewed the changes in this Plan revision and has determined that they do not reduce the effectiveness of the Plan or the overall Nuclear Security Program for Nine Mile Point Nuclear Station.
