On February 9,2011, the Nuclear Regulatory Commission (NRC) completed its end-of-cycle performance review of Nine Mile Point Nuclear Station (NMPNS), Units 1 and2. The NRC reviewed the most recent quarterly performance indicators (Pls) in addition to inspection results and enforcement actions from January 1,2010, through December 31,2010. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility.
 
This performance review and enclosed inspection plan do not include security information.
 
A separate letter will include the NRCs assessment of your performance in the Security Cornerstone and its security-related inspection plan.The NRC determined that overall, NMPNS Units 1 and2 operated in a mannerthat preserved public health and safety and met all cornerstone objectives.
 
The NRC determined the performance at NMPNS Units 1 and 2 during the most recent quarter was within the Licensee Response column of the NRCs Reactor Oversight Process (ROP) Action Matrix, because all inspection findings had very low (i.e., green) safety significance, and all Pls indicated that your performance was within the nominal, expected range (i.e., green).On March 25,2010, the NRC completed a supplemental inspection for a White Pl, associated with high unavailability of service water pumps, and determined that NMPNSs actions addresling these issues were appropriate.
 
The inspection was conducted using Inspection Procedure (lP) 95001, "lnspection for One or Two White Inputs in a Strategic Performance Areai'and the results were documented in inspection report 05000410/2010006.
 
Therefore, the White Plwas removed from the assessment process resulting in NMPNS transitioning from the Regulatory Response Column to the Licensee Response Column of the NRCs Action Matrix in theleconi quarter of 2Q10. The NRC plans to conduct ROP baseline inspections at NMPNS Units 1 and2.The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through June 30, 2012. Routine inspections performed by resident inspectors are not included in the inspection plan. The inspections listed during the last nine months of the inspection plan are tentative and may be revised at the mid-cycle performance review. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. ln addition to the baseline inspection program, we plan to conduct inspection Procedure 60853,'On-Site Fabrication of Components and Construction of an lndependent Spent Fuel Storage Installationl'
We also plan on conducting Inspection Procedure ,"Power Upratei'regarding NMPNS Unit 2 power uprate activities.
 
The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes.From January 1 to December 31,2010, the NRC issued one severity level lVtraditional enforcement non-cited violation that involved a willful act. Therefore, the NRC plans to conduct Inspection Procedure 927O2,"Followup on Traditional Enforcement Actions including Violations, Deviations, Confirmatory Action Letters, Confirmatory Orders, and Alternative Dispute Resolution Confirmatory Ordersl'to follow-up on this violation.
