On November 9, 2012, the State of New York (New York) filed a partially unopposed motion for leave to file additional exhibits concerning Contentions NYS-37 and NYS-5.1 In that motion, New York requests that the Board admit four exhibits (NYS000447, NYS00448A/B, NYS000449, and NYS000450), which relate to Contentions NYS-5 and NYS-37.2 The NRC Staff, Riverkeeper, Inc., and Hudson River Sloop Clearwater do not oppose the motion.3 Entergy Nuclear Operations, Inc. (Entergy) does not oppose the admission of NYS00448A/B, NYS000449, and NYS000450, but opposes admission of NYS000447 at this time.4 As grounds for its opposition, Entergy states that NYS000447 has not been referenced in any NYS-37 1
