The U.S. Nuclear Regulatory Commission (NRC or the Commission) has reviewed the U.S.
Department of Veterans Affairs (VA) proposed license amendment application for the Alan J.
Blotcky Reactor Facility (AJBRF), License No. R-57. The NRC received the application by {{letter dated|date=May 21, 2014|text=letter dated May 21, 2014}} (Agencywide Documents Access and Management System (ADAMS)
Package No. ML14150A404), as supplemented by {{letter dated|date=November 12, 2014|text=letter dated November 12, 2014}} (ADAMS Accession No. ML14335A597). The application involved amending Facility License No. R-57 to incorporate a Decommissioning Plan (DP), and was a minor revision to a March 8, 2012 DP submittal (ML12075A202). The revised DP updated the release criteria to properly reference Inspection and Enforcement Circular 81-07. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 20.1405 and 10 CFR 50.82(b)(5), the NRC published a notice and solicitation of comments for this DP in the Federal Register on June 20, 2012. The NRC also conducted a safety evaluation of the proposed DP. Based on these actions, the NRC has concluded that the DP demonstrates that the proposed decommissioning will be performed in accordance with the Commissions regulations and will not be inimical to the common defense and security or to the health and safety of the public.
Therefore, the Commission approves the application and amends Facility License No. R-57 to reflect the permanent shut down and defueled status and by amending the language of paragraph 2.C. (1) to read The licensee may not operate the reactor. The amendment also incorporates the DP into the license as a supplement to the Safety Analysis Report or equivalent, pursuant to 10 CFR 50.82(b)(5). No changes are necessary to the August 5, 2002 Technical Specifications (ADAMS Accession No. ML14016A457), which remain in effect. The approved DP is subject to such conditions and limitations as the Commission deems appropriate and necessary and as provided in the enclosed SER.
A Notice of Issuance of this amendment will be published in the Federal Register.
