Dear Gonzalo Perez:

We have reviewed the final revisions to the California regulations 30194, 30195, 30196, 30220, 30253, 30257, 30295, 30332.8, 30333.2, 30348, and 30373, received by our office on June 7, 2022. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-3, 2019-1, 2019-2, 2020-1, 2020-2, 2020-3, 2021-1, and 2021-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Phillip Scott on June 29, 2022.

As a result of our review, we have one comment that has been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comment, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by California, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other California regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Reporting requirements California regulation 30295(c) provides reporting information but does not include an equivalent provision to 70.50(c)(1)(iii)(D) which states:

Whether the remaining structures, systems, equipment, components, and activities of personnel relied on to prevent potential accidents or mitigate their consequences are available and reliable to perform their function;.

California needs to add an equivalent provision to section 30295(c) as indicated above to meet the Compatibility Category C designation assigned to 10 CFR 70.50(c)(1)(iii)(D).
