We have reviewed the final revisions to the Utah Administrative Code, R313-22-75, Special Requirements for a Specific License to Manufacture, Assemble, Repair, or Distribute Commodities, Products, or Devices That Contain Radioactive Material, and R313-32-2, Clarifications or Exceptions, of the Utah Administrative Code (Radiation Control Rules),
received by our office on February 15, 2024, to incorporate changes requested by the U.S. Nuclear Regulatory Commission (NRC) in a letter to the Division of Waste Management and Radiation Control (Division) dated December 5, 2023. These regulations were reviewed by comparison to the equivalent NRC rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS ID) RATS ID 2018-1, 2020-2 and 2020-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on April 5 2024.

Dear Douglas Hansen:

We have reviewed the final revisions to the Utah Administrative Code, R313-22-75, Special Requirements for a Specific License to Manufacture, Assemble, Repair, or Distribute Commodities, Products, or Devices That Contain Radioactive Material, and R313-32-2, Clarifications or Exceptions, of the Utah Administrative Code (Radiation Control Rules),

received by our office on February 15, 2024, to incorporate changes requested by the U.S. Nuclear Regulatory Commission (NRC) in a letter to the Division of Waste Management and Radiation Control (Division) dated December 5, 2023. These regulations were reviewed by comparison to the equivalent NRC rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS ID) RATS ID 2018-1, 2020-2 and 2020-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on April 5 2024.

As a result of our review we have no comments. Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that the regulations, as adopted, meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

The SRS Data Sheet summarizes our knowledge of the status of other Utah regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet.
